ATLANTA — Fulton County Superior Court Judge Scott McAfee confirmed to Channel 2 Action News that he will rule on whether to disqualify Fulton County District Attorney Fani Willis from the state’s RICO case against former president Donald Trump and 14 co-defendants on Friday.
There’s a lot riding on the judge’s decision, including the future of the case, not to mention Willis’ career as a prosecutor.
Channel 2 investigative reporter Mark Winne spoke exclusively to McAfee on the eve of that decision.
“What can you tell us about the timing of your order on the Fulton DA disqualification issue?” Winne asked McAfee.
“I made a promise to everybody. These kind of orders take time to write. I need to say exactly what I want to, and I plan to stick to the timeline I gave everyone,” McAfee said.
“So this week?” Winne asked McAfee.
“Should be out tomorrow,” McAfee said.

They LIED under oath, they are district attorneys, this judge lets that pass he should NOT be on the bench, it is a slap in the face to the entire judicial system!! WHY in the hell would ANYONE tell the truth under oath if this is let go???
I wonder if “mission statements” are aligned with Obama’s “We are five days away from fundamentally transforming the United States of America.”
What has been happening in cases like this is that the corrupt stuff is addressed, discussed, condemned in the strongest language... and then explained away as inconsequential or irrelevant so no consequences are meted out. Expect that, and if anything different happens, it's going to be a pleasant surprise. I don't believe we are at the part of the movie yet where the hero is getting his revenge.
The judge did say he has small children who won’t understand now but that he is looking forward to telling them later and telling them that he was true to the law and did the right thing.
West Point has been corrupted even within the small minded younger ranks....these are punks that have never had a taste of pure despair or raw life and death decision. All it takes is for a handful over the years to gain credential and then they teach...etc...etc... etcc. The cost for Liberty remains as it always has. I will fall for my fellow American if need be...God has plans for each of us and we will never know until we see his loving light. God be with us as we surely need his grace with all the dark around us.
Since this is a pre-trial motion, I would say yes, the prosecution can appeal the judge's decision to disqualify Willis and/or the entire Fulton County District Attorney's office.

Sadly he will give her a pass...that is why he threw out some charges...to show he was fair..
I am thinking he is to afraid do anything about/against Fanni and Wade - just my opinion - nothing will happen and Trumps case continue - Pray I am wrong
Yeah, I wouldn’t be surprised if the judge keeps her on the case. Looking out for his own butt.
I hope I’m wrong.
Ashleigh Merchant will become persona non grata in Fulton County.

It’s Fulton County, Jake.
I don’t think I’ve seen this before. I thought judges couldn’t talk about a case in progress.
“ He’s probably a coward.”
Pansy ass beta coward.
“ He’s probably a coward.”
Pansy ass beta coward.
>>>He must be profoundly conflicted because he is an appointee of NeverTrumper Governor Kemp yet is up for (re) election.
He has to weigh whether to please Kemp or risk the wrath of the voters.
there are rules that go with being a prosecutor. the money...the gifts...the lies...he never tried a case...the pings...
The choice is "appearance of" or "actual". Guess what...actual is there.
he’s not discussing it...not one little bit.
they didn’t drop it...they added to it.
Thanks for the post!
I agree that’s probably what’s going on, he’ll probably keep her but try to give the impression she’s on a tight leash. The right decision would of course be to not only remove her from the case but set up a separate trial to investigate her for likely perjury to the court.
I think McAffe made a decision to TEST THE TEMPERATURE WHEN HE JUDGED SIX CHARGES TO BE DISMISSED.
He thought...if there is NO NEGATIVE REACTION TO HIM IF HE MADE THAT JUDGMENT, HE WAS SAFE TO DUMP WILLIS.
There have been NO DEMONTRATIONS.
