Hospital pays job applicant who refused mandated flu shot

A hospital in Grand Rapids, Mich., has agreed to pay a settlement to a job applicant who had been offered a position, but then was arbitrarily rejected because he declined to take a flu shot hospital officials demanded.

The fight involved Trinity Health Grand Rapids, which previously was known as Mercy Health St. Mary's. The resolution includes a consent decree that allows paying of some $50,000 to the worker who was rejected.

The case originally was filed by the U.S. Equal Employment Opportunity Commission and charged the hospital improperly denied a job applicant’s request for a religious exemption to the flu shot.

The requirement for such shots later was dropped by the hospital, which agreed to train leaders on religious rights in addition to paying the settlement.

"According to the EEOC’s lawsuit, even though the hospital’s former flu shot policy allowed for a religious exemption, the hospital determined the applicant’s articulated religious beliefs were 'insufficient' to grant the exemption and denied it without an explanation. Trinity Health, which had made a conditional job offer to the applicant, then rescinded that job offer and did not give the applicant an opportunity to address the concerns with his request."

The EEOC accused the corporation of violating Title VII of the Civil Rights Act of 1964.

What is the point of protecting one from religious persecution, if there is no punishment for an organization who practices religious persecution?

Did you file with EEOC? That’s the starting place.

A person I know filed in Jan 22 - finally notified that “investigation” should be complete soon. He’s been sending every single one of these type articles to the investigator.

It’s interesting that someone who was NEVER HIRED got the sum that they got.

Regular flu vaccines lose 9% of effectiveness per month with the standard flu shot.

The researchers also determined that VE*, dropped 9% every 28 days—or a 1.09-times increased risk of influenza every 28 days (adjusted odds ratio [aOR], 1.09; 95% CI, 1.04 to 1.15). They did not, however, observe any VE waning in children.

Adults 18 to 64 years showed the greatest decline in protection against the H1N1 strain (aOR per 28 days, 1.26; 95% CI, 0.97 to 1.64). For people 65 years and older, it was against the H3N2 strain (aOR per 28 days, 1.20; 95% CI, 1.08 to 1.33).

Annual influenza vaccination programmes need to strike the balance between vaccinating the population too early versus too late.

The regular so called flu shots drop their effectiveness 9% every 28 days.*

When to get the flu shot:
The flu vaccine is produced by a number of private manufacturers and typically begins to ship to healthcare providers in August. However, there’s some evidence that it may not be advantageous to receive your vaccine this early.

A 2017 studyTrusted Source indicated that maximum immunity is achieved shortly following vaccination and decreases with each passing month. Therefore, if you get your vaccine in August, you may be more susceptible to infection late in the flu season, around February or March.

The Centers for Disease Control and Prevention (CDC)Trusted Source recommends getting the flu vaccine before influenza activity begins to pick up within your community, ideally by the end of October.
