My question is if no immunity, what specific criteria will they put forward to justify immunity or not? (other than Democrats - immunity, Republicans - no immunity)
Presidential immunity applies to all presidents. Except Trump.

I agree with his assessment. If SCOTUS rules this way it would basically follow the concept of qualified sovereign (employee) immunity. The question is whether Trump’s actions were in the normal course and scope of his position/employment .

How can SCOTUS carve out J6 from the immunity that judges and Congress have? It would be prejudging the case that Trump was not acting within his official on J6.

OTOH, the esteemed Alan Dershowitz told Greta Van Susteren last night that SCOTUS will probably assert Presidential Immunity.

Everyone knows this is 100% election interference - even the dumbest Democrats know it.
I don’t think the Supreme Court will want to be seen as complicit in election interference - and that’s the way everyone will see it - they would be flushing their credibility right down the toilet.
What “actions” are you referring to that Trump did?
In a sane world Trump should not even need to deal with immunity. Immunity for what?
Legal opinions are what counts in this case. Let’s see what other lawyers think. I suspect a mixed bag and a split SC decision.

I think they will say if you have a problem with the President, use the impeachment process which is why it was created, to prevent using DOJ as a political tool to go after Presidents.
