Trump bashes Biden, Justice Department for ‘political persecution’ in battleground Pennsylvania

HARRISBURG, Pa. — Former President Donald Trump called foul on the Justice Department’s decision not to seek charges against President Biden for retaining and disclosing classified documents while he faces prosecution on similar charges.

Speaking to a gathering of thousands at the National Rifle Association Friday night in this key swing state, the likely Republican nominee said if Mr. Biden wasn’t to be charged, neither should he.

“This is nothing more than the selected persecution of Biden’s political opponent, me,” Mr. Trump said.

Mr. Trump’s criticism follows a scalding report from Special Counsel Robert Hur that found Mr. Biden willfully retained and disclosed classified military and national security documents, but concluded that he would not face criminal charges. The report characterized Mr. Biden as an “elderly man with a poor memory” who would strike a sympathetic figure to a jury.

Mr. Biden and his administration have since pushed back against the report’s characterization, but that did not stop Mr. Trump taking a swing at the descriptions of the president’s failing memory. The former president said he’s not sure whether Mr. Biden is calling the shots in his administration.

I have been studying the inner workings of how the classification system works.

I am more confused now about Trump’s case than I was before!

What I have learned so far:

Must the president follow any specific declassification procedures?

The answer is a resounding no for two reasons.

First, Executive Order 13526 on its face contains no such declassification procedures.

The Order sets forth (1) who may declassify information and (2) what standards they should apply, but beyond that, there is no additional process required.

While both individual agencies and the Information and Security Oversight Office have developed additional rules about how declassification should be carried out, none of these procedures apply to the president.

Second, given the president’s constitutional authority over both classified information and the administration of presidential executive orders, even if Executive Order 13526 did establish constraints, they are at most self-constraints that the president has the power to ignore.

So if you are a Democrat, it is fine that you stored CLASSIFIED DOCUMENTS behind your Corvette in your garage, yet if a Republican does it, the FBI raids your house and try to keep you from running for President.

Democrats, please stop pretending you are for law and order, because you aren't!!
