Supreme Court justices indicate they’ll keep Trump on 2024 ballot in landmark case

WASHINGTON — A clear majority of the Supreme Court’s nine justices signaled Thursday that they would overturn a Colorado ruling barring former President Donald Trump from the state’s Republican presidential primary ballot.

The former president, 77, and his lawyers were appealing the Dec. 19 decision by Colorado’s Supreme Court that found Trump ineligible for the March 5 Republican contest by virtue of violating the Constitution’s so-called “Insurrection Clause” during the Jan. 6, 2021, Capitol riot.

Trump’s team argued separately that Congress — not the states — was tasked with enforcing the clause, that the provision did not apply to the office of president, and denied that the 45th president engaged in an insurrection by seeking to remain in office after his 2020 election defeat by Joe Biden.

During oral arguments, Chief Justice John Roberts fretted about the possibility that upholding the Colorado ruling would open the door to red and blue states removing politicians of opposing parties from the ballot on a whim.

“It’ll come down to just a handful of states that are going to decide the presidential election. That’s a pretty daunting consequence,” Roberts said.

Which Justices?

I’m not sure now that John Roberts will decide the right way. It depends on which side of the bed he wakes up on.

I hate titles like this. It has always been an omen to state what the USSC will do before they do it. Sometimes it seems like they rule the opposite just to spite others telling them what they will do.

SCOTUS says Trunp has to be on the ballot, but the states don’t issue ballots with his name on it. Biden gets elected again. What happens?

Congress will accept the electors. Look at 2020. They accepted the electors despite the challenges.

Yup. Alito laid it on the line. If SCOTUS were to let Colorado get their way, Biden will be removed in GOP states for giving aid and comfort to Iran.

If red states had only Trump and not Biden and blue states had only Biden and not Trump, would anyone get 270 electoral votes ?

Then it’d go to the House, and then what?

After listening to the arguments, I think it is more likely 6-3 to 8-1 for Trump, 7-2 being the oddsmakers favorite.

She really seemed like she was fascinated by the whole thing and all of the legal issues involved when she was asking questions of both sides - like she was having a good time. She was surprisingly even handed - at least in the way she was treating the counsels.

That doesn’t really mean anything as to how she might rule.

You may be correct, but I think that this CO ruling was so blatantly idiotic and biased, that even the Supreme Court zombies couldn’t go along with it.
