On Wednesday, Representative Joaquin Castro (D-TX) called on President Biden to "seize" the Texas National Guard by calling them into Federal service, removing them from the command and control of the State of Texas. This is presumably in response to Texas Governor Greg Abbott's defiant tone towards the Biden Administration on closing the border.
A Texas congressman has urged President Biden to take the state's National Guard under federal control if Republican Governor Greg Abbott defies a Supreme Court ruling allowing federal agents to remove razor wire from a section of the U.S.-Mexico border.
The call was made by Democratic Representative Joaquin Castro after Abbott posted on X, formerly Twitter, saying the Texas National Guard would continue to "hold the line in Eagle's Pass," a popular migrant crossing point, stating: "Texas will not back down from our efforts to secure the border in Biden's absence."
Castro re-shared Abbott's post on his own X account, adding: "Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border.
As of this writing, there has been no action on this by the Biden Administration.
This idea by Rep. Castro raises some interesting questions:
1) Were the President to activate the Texas National Guard under Title 10, what would their orders be? To assist federal officers in throwing open the gates?
2)What happens if members of the Texas National Guard refuse activation and instead continue to follow the orders of TX-ANG officers and Governor Abbott?
3)What if the Texas Guard splits, and former comrades end up facing each other across that red line?

Abbott is a great Governor and they only Republican I’ve heard from so far who has confronted this bastard Biden.

“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now,” reads the statement. “President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That is a well-reasoned and sad post. Every American should greatly fear this possibility, but at some point the tyrannical government simply refuses to back down and respect the will of the people. The founding fathers also feared this possibility and yet provided guidance.
That’s the plan.

Texas has the Texas State Guard. It’s not subject to federal orders.

This letter that Abbott drafted is some Serious language.
Unfortunately, the federal courts said otherwise when Obama sued Arizona over their SB 1070 bill.
The court basically said that federal prosecutors had "prosecutorial discretion" over where to spend their efforts (e.g., which illegals to prosecute and/or deport), and any state law infringes on the federal agencies' authority to exercise discretion.
In other words, the court said that if a state like Arizona kept arresting illegal aliens on their own and then turning them over to Border Patrol or Homeland/Immigration, that forces those agencies to have to deal with the illegals which takes time and budget away from other priorities that they had the power to set.
Letting states arrest illegals forces priorities onto the federal government, which the courts overturned.
It's like the states are the serfs for the federal government and not the other way around, which is what the 9th and 10th amendments were supposed to be for.
