Laura Loomer, a die-hard Trump supporter, is taking a page out of Hillary Clinton’s playbook by going into full birther mode.
'Nikki Haley Is An Anchor Baby Who Is Unqualified To Be US President,” an article posted to her website on Christmas Eve insists. Her piece argues that since her parents were Indian immigrants who didn’t become naturalized U.S. citizens until after her birth, Haley is an “anchor baby” with birthright citizenship and doesn’t qualify as a “natural born citizen."
She shared her article on X/Twitter, and users promptly flagged it with a Community Note.

Loomer was livid when a Community Note flagged the post. "Why do @CommunityNotes censor factual posts?" she asked in a follow-up post on X/Twitter. "Read this article and see for yourself how this is wrongfully community noted. Natural born citizenship isn’t the same as birthright citizenship."
There were plenty of her supporters agreeing with her, as well as those calling her out for being flat-out wrong.
But what are the facts? Here’s what the Legal Information Institute of Cornell University says on the matter:
A natural born citizen refers to someone who was a U.S. citizen at birth, and did not need to go through a naturalization proceeding later in life. Under the 14th Amendment's Naturalization Clause and the Supreme Court case of United States v. Wong Kim Ark, 169 US. 649, anyone born on U.S. soil and subject to its jurisdiction is a natural born citizen, regardless of parental citizenship. This type of citizenship is referred to as birthright citizenship. One can be a citizen while not being a natural born citizen

The key question would be whether or not Haley’s parents were in the country legally when she was born. If they were and were not diplomats, they were “subject to the jurisdiction” of the United States. It can be reasonably argued that those who enter the US illegally are not subject to the jurisdiction of the US and while their children might be able to become citizens, they would not be natural born citizens.
I will be very reluctant to cast a vote for Nikki Haley, even if Trump ends up choosing her as his VP running mate. That said, the “natural born citizen” issue is settled. It’s over. And Laura Loomer, by all accounts, is a nut - Trump’s cause is not well-served by people like her.

There are two possibilities. Haley's parents either were naturalized citizens when she was born, or were in the process of becoming US citizens when she was born. In the first case, the children born of legally naturalized parents are NBC like all other second generation children of legal immigrants. In that case, legal filings claiming she is not a NBC are falsehoods that will get thrown out of court until the courts are tired of a lawyer making a fool of himself.
If her parents were in process of becoming citizens when she was born, US law and court practice treat children born of naturalizing but not yet naturalized citizens as NBCs. They are not citizens of their parent's home countries, they were born on US soil, and US citizenship is governed solely by US law, foreign citizenship law has no bearing on US citizenship law. There are only two types of legal citizens, NBC and naturalized. There is no other citizenship categories. Period. Full stop on no other citizenship types.
Short version, as I understand it, allowing the children born of naturalizing citizens who become naturalized citizens, while they are becoming naturalized citizens to be NBC, keeps the law and legal process simpler and usable. It also prevent creating a third type of citizenship which does not exist under US law or have any precedent in the courts.
I hope this makes some if not complete sense. Immigration and citizenship ship law is has a particularly messy history.

The question centers around the meaning of the term “natural born citizen”. A compelling argument can be made, based on writings at the time of the Constitution’s framing, that the status of being a natural born citizen was not something that could be conveyed by statute and whose meaning was clear out the Constitution’s outset.
Being that birthright citizenship (i.e. automatically granting citizenship to anyone born on U.S. soil, regardless of their parent’s status) is a novel concept that wasn’t accepted by the framers, it’s likely that their meaning of the term didn’t include anchor babies or children born on U.S. soil to non-citizen parents.
We don’t grant citizenship to children born in the U.S. whose parents are ambassador’s from other countries. The idea of granting natural born citizen status to the offspring of a UN ambassador from Pakistan’s wife, because he or she was born in New York is patently absurd. How different is it to have been born in this country from non-citizen parents who were not ambassadors? Not very, IMO.
Some believe citizenship comes from the child’s parents and the child inherits citizenship from father and from mother.
On the other hand, some believe that citizenship comes from the soil, from the country where the child is born.
The only case where all would agree the child is a citizen, A “Natural Born Citizen”, is when the child is born in country to citizen parents.
That’s the only time when the citizenship inherited from father, mother and country is the same for each one.
If the President is going to be the Commander in Chief of all of us, then all of us need to agree that he or she is a citizen of us and has a natural born allegiance to us and to no one else.
Thus, Natural Born Citizenship defined as born in country to citizen parents has to be a requirement to be President.
