I argue that Section 3 of the 14th Amendment does not apply to the Presidency since that office is not specified in the first part of the section and it is not an office UNDER the United States thus not covered by the second part of the section either.

What I think the left will eventually try to do is use Section 3 to disqualify many staunch Trump electors in purple states if Trump wins in those places, in the hopes of getting enough faithless Electors seated to tip the Electoral College in their favor.

No. This is simply false. Already in two cases, courts have ruled this is unconstitutional (Majorie Taylor Greene in GA, Madison Cawthorne in NC). A third case in NM was successfull only because the congressional candidate was way low on funds and didn’t appeal.

I’ve been over this and over this. The 14th ONLY refers to the Civil War as courts have repeatedly ruled and is clear by the language; it DOES NOT specifically include the President for a reason, as he cannot be guilty of secession against his own country; and because Jeff Davis was NOT recognized as a President; therefore the wording does not include “President.”

Already the DemoKKkrat Hobbit in AZ was told that this was unconstitutional and she couldn’t do it.

Im not so sure.If they squeak it through a lower court expect the Supreme Court to get involved. There was no actual insurrection, so theres that and the fact that such trusted (by leftists) assets , like the FBI, have stated unequivocally that Trump himself had no actual role in the protest that day does have meaning. We can put Trumps speech about protests being peaceful and the GOP needing to be the party law and order on a big screen and play on a loop for the jury...

One by one they will fail.... imho

Anybody relying on the 14th Amendment to defeat Trump in 2024, is depending on a pretty weak or broken reed.

These articles are for the “walls are closing in” on Trump crowd, in other words it’s “boob bait” for Trump haters.

Trump can't really be removed from general election ballots. State Republican parties nominate the slates of electors and they can be pledged to Trump, and fulfill those pledges, even if Trump's name isn't listed on the ballot next to that elector slate.

He can be removed from primary ballots. The RNC needs to pass a rule that it will hold caucuses in any state that prohibits Trump from primary ballot access, and those caucuses will alone choose the National Convention delegates. If the RNC doesn't do that, Trump could easily lose the nomination.

From the Amnesty Act of 1872:

<>Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each house concurring therein), that all political disabilities imposed by the third section of the fourteenth article of amendments of the Constitution of the United States are hereby removed from all persons whomsoever, except Senators and Representatives of the thirty-sixth and thirty-seventh Congresses, officers in the judicial, military, and naval service of the United States, heads of departments, and foreign ministers of the United States.<>

This is further proof that Section 3 of the 14A applied to Civil War rebels and no other.

The Act removed all political disabilities except those cited.

Neither President Trump nor any current politicians can be restricted from public office by the 14A.

Also, Section 5 empowers Congress and not the judiciary, states, local dippy prosecutors or no-name lawyers to enforce the 14A.

The problem as I see it (and hasn't been mentioned by others) is that they don't need the 14th amendment; there is also 18 U.S. Code § 2383 - Rebellion or insurrection:

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.
Someone first needs to indict someone for insurrection under this federal code, not the 14th amendment.

Trump has not been found guilty of insurrection in a court of law.

Last I read, Trump hadn’t even been charged specifically with insurrection.
