“Secretary of State David Scanlan, who will oversee the first-in-the-nation presidential primary in just five months, said he’s received several letters lately that urge him to take action based on a legal theory that claims the Constitution empowers him to block Trump from the ballot.

“Scanlan, a Republican, said he’s listening and will seek legal advice to ensure that his team thoroughly understands the arguments at play. …

“‘I have some in-house staff attorneys that are election experts,” he said. ‘I will be asking the attorney general’s office for their input. And ultimately whatever is decided is probably going to require some judicial input.’” …

“Here in New Hampshire, the GOP’s 2020 nominee for the first congressional district, attorney Bryant “Corky” Messner, said in a radio interview Monday that he read about the legal theory and is now thinking about suing to ensure that Scanlan enforces the Constitution against Trump.

It is not a crime to dispute the results of an election. Going back several decades since the republicans promised NOT to dispute them, why would we fault Trump for being an honest critic, when WE know w/o a shadow of a doubt that it was stolen from him. I refuse to kneel at the altar of this LIE!

All that he has been so-called convicted of is a hill of beans not worthy of the $$$ spent on it. Think back since WWII and tell me how many presidents have been corrupt? The list is shocking and the crimes are WAY worse, and yet most of them were never impeached or even talked about as felonies. This is a sham public circus!

The legal theory must be struck down.

The Constitution is full of examples where a person must have due process before a punishment can be meted out.

It is against the Constitution for a single person to unilaterally decide a punishment without due process.

Nobody has the Constitutional authority to keep someone off of a ballot for "insurrection" before a court process finds that person guilty of insurrection.

Since he controls the elections in NH he must abide by both state and federal/constititional law. There is some ambiguity and he’s looking for legal guideance. As he should.

It states. “No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability.” Nowhere does it say convicted.

I agree. But it’s long-standing American tradition to presume innocence unless proven otherwise. And that’s the way it must be. Otherwise, an evil president could just declare any Republican who said something wrong to be in rebellion, and thus ineligible for public office. Most of today’s Democrats would applaud such a move.

Then it would be up to the Supreme Court to set things right. But who knows what that court will be like 10 or 20 years from now?

Better to insist on that American tradition.

This will have to be settled by the Supreme Court.

The Left will simply ignore Supreme Court rulings that they disagree with. After all, the court is "illegitimate" in their eyes. Look how Biden continues to promise student loan bailouts.

The only reason they're not ignoring Dobbs is because it turned into a massive get-out-the-vote bonanza for Democrats.

Here's what will happen. If polling shows Trump is at any risk of beating Biden, they'll keep him off the ballots (already in the works).

If he wins a write-in campaign, faithless electors will flip or they'll deny him the electoral count.

There is no way they are letting Trump back in the White House without a fight.
