Truth Social Post Prompts Jack Smith to Ask Judge to Prevent Trump from Releasing Discovery Evidence to Publi

Special Counsel Jack Smith on Friday asked a judge to issue a protective order in the case against former President Donald Trump over his alleged efforts to overturn the 2020 election after Trump made a post on Truth Social.

On Friday, Trump posted the following message to his Truth Social account: “IF YOU GO AFTER ME, I’M COMING AFTER YOU.”

Now, Smith is using that post to argue Trump’s access to the discovery in his criminal case should be restricted. Smith’s proposed order seeks to prevent “improper dissemination or use of discovery materials, including to the public,” according to a four-page filing.

“Such a restriction is particularly important in this case because the defendant has previously issued public statements on social media regarding witnesses, judges, attorneys, and others associated with legal matters pending against him,” Smith argued before referencing Trump’s Truth Social post. “And in recent days, regarding this case, the defendant has issued multiple posts either specifically or by implication including the following, which the defendant posted just hours ago.”

“If the defendant were to begin issuing public posts using details or, for example, grand jury transcripts obtained in discovery here, it could have a harmful chilling effect on witnesses or adversely affect the fair administration of justice in this case,” Smith argued.

A Trump spokesperson defended the Truth Social post as “political speech” and denied it was in reference to the criminal case.

”The Truth post cited is the definition of political speech, and was in response to the RINO, China-loving, dishonest special interest groups and Super PACs, like the ones funded by the Koch brothers and the Club for No Growth,” the spokesperson said.

I will grant your request with one condition. The order applies to the DOJ also, and just to be clear Mr Smith, if there are ANY leaks of Information on the Government side, you sir will be held in Contempt of Court and sanctioned $100,000 and 30 days in Jail, General Population, for each and every leak coming out of the Government.

This is really simple.

The Dems take all this action (Schumer is involved) because they know the GOP won’t do anything like it in return.

There’s no downside. Elected Republicans are always poised to Surrender.

These tactics will never be used against them. They’ll be used to fundraise, and then you end up with Lindsey and the Surrender Monkeys pushing the Dem’s agenda again.

Harvard Law School professor emeritus Alan Dershowitz says that under his own “fraud” standard, Special Counsel Jack Smith could be indicted for omitting a key portion of then-President Donald Trump’s speech in Washington, D.C. on January 6, 2021.

The indictment charges Trump with four counts, including “conspiracy to defraud the United States.” But in a portion recounting Trump’s speech at the “Stop the Steal” rally, Smith repeats the errors made by House Democrats in Trump’s second impeachment trial: he focuses on Trump’s use of the phrase “fight like hell,” and omits a sentence highlighted by Trump’s defense team: “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.”

Dershowitz told the Megyn Kelly Show podcast on Friday that by his own standard, Smith could be charged with fraud, because of his omission of Trump’s “peaceful” rhetoric.

“Under the indictment itself, Jack Smith could be himself indicted. He told a direct lie in this indictment. He purported to describe the speech that President Trump made on January 6th. And he left out the key words, when President Trump said, ‘I want you to demonstrate peacefully and patriotically. You know, a lie by omission, under the law, can be as serious as a lie by commission.”

The fact that Smith repeated the error of the House impeachment managers would appear deliberate, because these phrases were the crux of Trump’s Senate trial. Trump’s lawyers even played footage of Democrats using similar “fight” rhetoric, to show its common usage.

Trump’s defense team returned, again and again, to the fact that Trump told his supporters to rally “peacefully” at the Capitol, which was ultimately a major reason he was able to defeat the House impeachment charge of incitement.

Innocent until proven guilty? Nah, we tell everyone you’re guilty of something, but we can’t let the public see what we’re accusing you of. Guilty and you will never be able to prove innocence because we won’t let you! That’s how Democrat “justice” is done now.

The court wouldn’t permit Alex Jones to present exculpatory evidence. He wasn’t even permitted to say he was innocent.

Every guards life and family will be in danger.
You’ll need the National guard to keep that prison safe.

I think one of the biggest tells in all of these “prosecutions” is that they brought this moron in from Europe, where he was doing nothing but collecting a check, and their desperation is making them throw anything they can think of, no matter how outlandish, at the man. Smith wants a quick trial in DC because they’re confident that they’ll get a guilty verdict. Just enough for Congress to act to try and make Pres Trump ineligible and something that will keep him off ballots in states, even some RED ones, like Georgia.

18 U.S. Code § 1512 - Tampering with a witness, victim, or an informant

(a)
(1)Whoever kills or attempts to kill another person, with intent to—
(A)prevent the attendance or testimony of any person in an official proceeding;
(B)prevent the production of a record, document, or other object, in an official proceeding; or
(C)prevent the communication by any person to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation, parole, or release pending judicial proceedings;
shall be punished as provided in paragraph (3).

(2)Whoever uses physical force or the threat of physical force against any person, or attempts to do so, with intent to—
(A)influence, delay, or prevent the testimony of any person in an official proceeding;
(B)cause or induce any person to—
(i)withhold testimony, or withhold a record, document, or other object, from an official proceeding;
(ii)alter, destroy, mutilate, or conceal an object with intent to impair the integrity or availability of the object for use in an official proceeding;
(iii)evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official proceeding; or
(iv)be absent from an official proceeding to which that person has been summoned by legal process; or
(C)hinder, delay, or prevent the communication to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation, supervised release, parole, or release pending judicial proceedings;
shall be punished as provided in paragraph (3).

Not sure where posts on social media, interviews or speeches constitutes violence in an attempt to keep someone from talking to the cops is witness tampering, but it would be real interesting to listen to Smith try to argue that point, in a televised courtroom. This partisan hack should lose his law license and anyone helping him should lose that or their badge and gun.
