Biden’s attempt to regulate pistol braces dealt blow after appeals court casts doubt on constitutionality

The Biden administration’s effort to regulate pistol braces was dealt a blow Tuesday after a ruling by a federal appeals court cast doubt on its constitutionality.

The Biden admin rule required gun owners to register pistol braces, which are accessories that can be attached to the rear of a gun to make it easier to aim and fire with one hand.

Second Amendment proponents argued that the braces make handguns safer and more accurate. But gun control advocates argued the braces could be used to lengthen a concealable handgun, making it more dangerous.

Two Texas gun owners, a gun rights group and a gun dealer filed a lawsuit challenging the law. The Texas-based federal judge presiding in the case refused to block the rule, which required registration of the devices and payment of a fee. But in May, the 5th U.S. Circuit Court of Appeals issued a temporary block of the rule as it applied to the plaintiffs, their customers, and members.

The 5th U.S. Circuit Court of Appeals in New Orleans said Tuesday the Biden administration’s rule requiring registration for the braces was unlikely to survive a legal challenge.

Pistol Brace owners can join GOA or Second Amendment Foundation as members are immune to ATF while this issue is under court review. All current members are shielded from any ATF harrassment over pistol braces.

It makes the pistol more dangerous. Last I checked, this was the main point of a pistol.

If by dangerous one means likely to hit something other than the intended target, I think one could argue that it makes the pistol safer.

But gun control advocates argued the braces could be used to lengthen a concealable handgun, making it more dangerous.

So if a firearm is more concealable it is more dangerous but now if it is less concealable it is more dangerous. OK

If it’s a class action, wouldn’t you have had to have been a member before the lawsuit was filed?

I have AR-15 in rifle, pistol and NFA SBR tax-stamped configs. I never configured the pistol format with a brace. Frankly, the AR-15 pistol with a naked buffer tube is awkward to shoot. If the SBR process was less onerous and expensive, I would convert all the naked buffer pistols to proper SBR. ATF could do that in a heartbeat and clear the lawsuits in short order. It seems ATF is more motivated to manufacture a crime by definition vs a simple resolution.

I believe one of them , possibly the SAF the judge ruled ALL members past and future. Always verify. I joined SAF because of that.

My company has its own private pistol/rifle/Trap range that hosts the local cops shooting day. So ATF can suck my nuts. Brace stays on. Ill shoot it when I want.

I love PSA’s stuff.
Unfortunately, they won’t ship to areas run by commies (Denver).
And, no. I didn’t vote for it.
My vote hasn’t mattered here since Griswold the Soros commie c**t took power here...

“But gun control advocates argued the braces could be used to lengthen a concealable handgun, making it more dangerous.”

There used to be a popular term for word salads like this and the above statement is a perfect example “Pretzel Logic.”

These “braces” were designed for disabled vets and others who needed forearm support for their shooting sports activities. I wonder why the ADA hasn’t been invoked?

I have severe arthritis in both hands and wrists, without the brace it’s very tough for me to properly steady my .300 Blackout Home Defense AR Pistol.

RE: "But gun control advocates argued the braces could be used to lengthen a concealable handgun, making it more dangerous."

Huh? Making it more difficult to conceal and more accurate makes it "more dangerous"? SMH.

OK, is it rule or a law?

Everyone knows that in order to properly conceal something, you must make it larger. You want to conceal even a 3” long derringer, the most effective way is to hook a 10” long gunstock to it and stuff it under your shirt.

~~~~~~
This.
Add this too: Logically, the DOJ will plead that, in order to exempt these 2nd Amendment foundations’ members from enforcement the ATF must know who the pre-injunction members are. The DOJ will subpoena lists of these members with their membership dates.
The ATF would follow up with search warrants for the residences of all members who signed up after the injunction.
