A federal judge in New York has rejected former President Donald Trump's request to move his hush-money criminal case into federal court.
"Trump has failed to show that the conduct charged by the Indictment is for or relating to any act performed by or for the President under color of the official acts of a President," Judge Alvin Hellerstein wrote in his ruling Wednesday.
Trump has pleaded not guilty to a 34-count indictment charging him with falsifying business records in connection with a hush money payment made to adult film actress Stormy Daniels days before the 2016 presidential election.
He had argued the case belonged in federal court because Trump reimbursed his then-attorney, Michael Cohen, who made the payment to Daniels, while Trump was in the White House.
Manhattan District Attorney Alvin Bragg had argued that the hush payment had nothing to do with Trump's presidential duties.

From the explanation for the ruling in the excerpt, it sounds as if Trump’s lawyers filed this with the wrong arguments.

Anyone who isn't buying the Narrative on Trump is seeing the federal clown judges revealed as the partisan stooges that they are.
Which by extension makes most if not ALL the federal judiciary partisan stooges - since they're not speaking out about the stoogery.
Hellerstein also endorsed the Manhattan district attorney's theory of the case that elevated the falsification of business records to felonies because, prosecutors said, Trump allegedly falsified the records in furtherance of another crime.
"Trump can be convicted of a felony even if he did not commit any crime beyond the falsification, so long as he intended to do so or to conceal such a crime," Hellerstein said.
This ruling is patently absurd. The criminal charge in this case only applies if the defendant falsifies records to cover up a crime, but this judge claims the prosecution doesn’t have to demonstrate that a crime was actually committed?
More importantly, this judge should be disbarred and removed from the bench just for acting outside his legal authority. A Federal judge has no business making a decision to remand a case to a state court, then render an opinion on a matter that comes entirely under the purview of STATE law.
Trump needs to start requesting the exact opposite court action that he prefers. This way, the petty and spiteful #Never-Trump judges will inadvertently act toward his benefit.

Exactly. The judge’s opinion was a straw man argument by a Clintonista looking to curry favor with the regime and get a higher appointment. The basis for federal intervention is obvious.
The deep state has spent years corrupting the judicial system. After all it is where everything comes to its ultimate conclusion. So it was highest priority.
The losses keep piling up.
Has Trump won anything since his 2016 win. In court he has repeated lost.
Three Supreme Court justices.
Lots of great Supreme Court decisions.
Stormy had to pay him.
The attorney went to jail.
He’s had lots of great wins.
