9th Circuit Court orders cities and towns cannot force homeless people off the street

The most powerful federal appeals court in the western United States once again refused to let cities and towns force the homeless off of the streets unless communities provide shelter for them.

Cities large and small across the west coast have tried, and failed, to overturn the higher court's ruling for years, the latest of which came from the Oregon city, Grants Pass.

"We are having a situation where the police were telling homeless people that they couldn't sleep in public or private, and private property," said Grants Pass Mayor Sara Bristol. "And eventually, that kind of boiled down to homeless people feeling like they couldn't find a place to rest where they weren't being harassed."

Bristol said the ruling highlights deep political divisions in her city and county. There are currently a few solutions on the table.

"There's been so much discussion and controversy in the community that we're kind of at a standstill about what to do about it," said Bristol. 

This court has dictated Los Angeles' response to the homeless crisis for years. The city was forced to accept encampment because of a staggering shortage of shelters. 

But the court was more divided on this case than ever with a growing number of judges appointed by former President Donald Trump lashing out. They claimed the homeless, by occupying public space, are destroying the quality of life in many cities. 

"Homelessness is presently the defining public health and safety crisis in the western United States," wrote conservative Judge Milan Smith Jr. "There are stretches of (Los Angeles) where one cannot help but think the government has shirked its most basic responsibilities under the social contract: providing public safety and ensuring that public spaces remain open to all."

I had a shovel back in the 1960s that was branded with WPA on the wooden handle.

Clinton had a workFare program when he was Prez.

Collect these bums up at 8am
AND bus them to a job site.

Give them donuts and coffee on the way and have them dug ditches and foundation holes.

Baloney sandwich for lunch then hose them down and take them to an empty building to sleep

Or give them hoes and have them hoe weeds all day.

Next day, rinse and repeat.

If they are too weak, set up a big tent clinic and give them some cold turkey.

Strap them to a cot if they complain.

Too bad, so sad.

It's really a shame you don't care so much about the homeowners and other responsible citizens not having a place to rest where they don't feel harassed.

It’already happened in Grants Pass. The homeless started setting up tents in all the city parks, leaving their trash and needles everywhere.

It wasn’t until there was a murder that the city woke up, shut down Riverside park for a month, and now they say you can’t camp in most of the park.

They tried setting up a homeless camp here in Grants Pass, but it was two blocks away from an elementary school and no one wanted them that close to kids.

They are not homeless...they're drug addicts/prostitutes/convicted criminals most who live 'their lifestyle' because that is what they want....they use rehab as a warm place to be in the winter but return to the streets for the love of their next high. Many are in their 30's and 40's who began using hard drugs in their 20's....they know how to invoke empathy in order to sustain their lifestyle. They do not want anyone telling them what to do nor do they want the responsibility that goes with living a clean life. Make no mistake they love the drugs that keep them stuck where they are.

Their love of their drugs is so very cruel to their families....many who are raising their 3,4,5,6, kids for them. And then they have more to pawn off to anyone who will take them.

They are incredibly selfish people even among like addicts who will steal the shirts off each others backs. For the majority they see rehab and detox as a means of less than desirable drugs to clean them up some.... so they can go back and do it some more. They will use and abuse everyone.

I don’t know if this has changed, but some years ago it was reported that 92-94% of 9th Circuit rulings that went up to SCOTUS were overturned.

There was a time vagrancy was a crime. It may seem cruel but it was understood that if a person did not have a job or money the only way they would survive is by stealing what they needed (or wanted).

Vagrancy laws protected law abiding (and productive) citizens.

It seems the courts have broken the social contract between those governed and those who govern.

History shows that this will not end well.
