It has been an incredibly wild (and based!) week with the decisions the Supreme Court has handed down, including the Friday rulings upholding religious freedom and effectively grounding Joe Biden’s student loan forgiveness program.
But though the leftist meltdowns have been plentiful, what has been far more fulfilling to read have been the dissections of what the dissenting liberal Justices wrote on the Thursday affirmative action case ruling and the Friday one pertaining to religious freedom.
Some of those dissections, as we previously reported, came from the court’s conservative members like Neil Gorsuch, who savaged Justice Sonia Sotomayor’s dissent in the 303 Creative case. There was also Justice Clarence Thomas’ straight-fire takedown of Justice Ketanji Brown Jackson‘s race-based arguments in the affirmative action case.
But one doesn’t need to be a brilliant conservative Supreme Court Justice to be able to spot a wildly questionable claim, which is what happened after Justice Jackson’s dissent in the Students for Fair Admissions vs. Harvard/UNC case came under closer scrutiny by legal experts.
In her dissent, Jackson argued in part that “the diversity that UNC pursues for the betterment of its students and society is not a trendy slogan. It saves lives.” And to back up her claim, she cited a brief from the lawyers for a medical group (starts on page 230) which she said proved that black doctors treating black high-risk newborns “more than doubles the likelihood that the baby will live”:

For a Justice of the Supreme Court of the United States of America to state such a thing in an official dissenting opinion shows exactly how far our nation has fallen. It also shows the harm that affirmative action has caused to our nation's institutions.
As mentioned in this linked article, the difference is 99.96% vs 99.91%.
She’s not a biologist and clearly not a statistician.
Jackson, The Wise Latinx, and Kagen are all excellent examples of the failures of affirmative action. I hope that is apparent to the vast majority of Americans.
The difference is 99.96% vs 99.91%. And the difference isn’t even statistically significant.
Her lie has served its purpose. Even when it’s corrected, leftists will remember and repeat the lie instead of the truth.

I assume her reasoning was that the number “6” was more than the double of “1” and thus her conclusion.
Or, am I giving her too much credit for even having that much mathematical genius?
This justice has staff attorneys and clerks at her beck and call, not to mention the other Justices themselves. Was no one at the Supreme Court able to explain her error to her in a manner she could understand?
Since when are Supreme Court justices expected to understand statistics? They don’t even need to understand basic biology.

I hoped the same thing twenty years ago when it came to the issue of making hiring decisions based upon basic knowledge, intelligence, and experience rather than checking boxes to make sure there was the correct mix included.
I’m still waiting for my hopes to be realized.
She is a stupid and ideological as expected. Both her and Dotomayor are trying to outdo each other for most stupidest. But I think Katanji will win every time with her “I don’t know what a woman is...”
Black doctors and nurses actually murdered patients, including children for years...Hospital was called KILLER KILNG.....The last patient was Edith Isabel Rodriguez..Horrific death at Killer kIng, but they shut down the hospital and her death saved countless would be victims......
Lets say for sake of argument shes right.
Its not up to the rest of the country to make this happen for them.
Where are the blacks investing in other blacks? Where are they telling their kids to study hard so they can become doctors? All I hear is kids saying getting good grades and studying is acting white.
Nothing they see and hear at “home” tells them otherwise.
You don’t get to be a doctor simply by being awarded a slot because you’re black.
Trillions have been spent and confiscated and turned over to these people and its done absolutely nothing except make them more dependent and more entitled.
May as well have Whoopi Goldberg on the Supreme Court...
I was turned down, in the 1970’s, for a truck driving job with a major grocery wholesaler, due to AA.
The interviewer flat out told me he’d like to hire me on the spot, but had to fill 3 AA positions first. They hired 3.
#1 didn’t show up for the first day of work, #2 made 3 trips & quit, #3 showed up drunk, about 3 days in.
I found other employment in the mean time, so never went back.
In 1975 I went into a local headhunting firm here in Indianapolis after college. the man I was talking to told me bluntly that if I was black or even better a black woman, he could get me an interview with any Top 500 corporation in the country. But as white male his options were limited. He also told me if I ever told anybody that he’d deny it vehemently.
All right, so basically the white doctors and black doctors have the same survival rates. But if the white doctors are treating the critical care babies, who have a lower chance of survival, doesn’t this say the exact opposite of what the judge is claiming? Doesn’t it mean, carried to its conclusion, that the white doctors have the same success rate as black doctors even though the white doctors are caring for critical care babies?
Fortunately, Clarence Thomas is on the Supreme Court. They can’t accuse the SCOTUS of being “racist” in its recent ruling.
Sure they can. They do it all the time. They say he is not "authentically black".
Yes, the babies fighting to live in a NICU are ALREADY AT THE POINT OF DEATH. There are more “white doctors” serving in the NICU’s than in general care and in newborn baby care.
Yes, they (black babies in the NICU) will die more often under a “white doctor’s care” .
But more than 1/3 of all black babies are aborted every year.
