As soon as the federal indictment of President Trump was unsealed, we were treated to stories featuring photos of “boxes of documents” stored in various rooms at Mar-a-Lago — including boxes in places like on the stage in the White and Gold Ballroom, and even in a bathroom:
Like the photos from the raid showing classified documents splayed out on the floor, these photos created a certain impression with the public. Just look at how many boxes there are! Look where they were put! Dozens of boxes all over the place, where anyone could get them.
But as Newsmax host Greg Kelly pointed out, it’s “a scam” that’s poisoning the public’s perception of Donald Trump in this case. Why? Because, as Kelly noted, the actual number of classified documents that were found at Mar-a-Lago could fit into one single box, with ample room to spare.
“You don’t have to be a lawyer to look at this and know that it’s a scam,” Kelly said. “Number one, in that indictment, they put some pictures in the indictment to scare us. Ooh, look at all these boxes. The classified documents in the boxes. These pictures are actually in the indictment, and there are dozens and dozens of boxes.”
He continued, “So I went through the indictment and saw that how many documents, classified documents, did the FBI actually recover? 102.”
Kelly then pulled out a box like the ones in the photos. “So, everybody, I got a box right here, alright? This is one box.” He then showed an intact full ream of paper — 500 pages — plus another 100 sheets of loose pages to represent the actual classified documents that were found. They didn’t even come close to filling a single box.

“ If a president has the legal right to be in possession of documents, he cannot also be prosecuted for such possession.”
But Trump is not president anymore. And there are documents he could have in his possession as president he cannot have as ex-president. If he fails to return them, he can be prosecuted for failing to do so. At least, that is the position of the prosecution.
Let’s go with your argument. Nowhere in the indictment do the prosecutors identify which box/es in the photos contained the alleged classified documents, (some had no classification markings according to the indictment).
So what is the purpose of the photos? Are they inferring that the documents were contained in those boxes or is it inferring that this is how all documents were handled by Trump’s people?
My understanding is that all the documents found during the various searches, (Trump attorneys and the FBI), were located in his office and the locked storeroom, thus the photos of the ballroom and the bathroom are only there for prejudicial purposes.
The first fight for Trump’s team is to have any photos of and references to boxes in any location that is not tied directly to any of the documents that are identified in the indictment, declared off limit to be shown/presented to the jury, (prejudicial and not proven/alleged to be associated with the charged offenses). That may require Smith’s team to have to file an amended indictment removing the photos and any mentions of the ballroom and bathroom.
Keep in mind that Smith must know where the box/es were found and in which box/es the documents which are the subject of the indictment were located, (unless the FBI was so sloppy that they did not document the location of the found documents at the time of the search). When, while doing a search, evidence is found the standard procedure is to immediately photograph it and where it was found so that chain of custody is established.
Trump is a neat freak. He would not have cardboard boxes on the stage in his Mar—a-Lago home. It is so obvious that this was a setup.
But if there is no record of the document being declassified, and it is still marked as classified, how do you prove it was declassified? Your statement may be true, but doesn’t resolve the quandary.
The indictment does not specify where the classified documents found during the raid were located.
I’m sure the point of the pictures is to establish a recklessness in handling the documents.
What does that have to do with anything? Nobody is cited in the indictment as stating what the contents of the boxes were. There is no way to claim that any of the 31 documents were located in one or more of the boxes in the photos so their inclusion in the indictment is for purposes of prejudicing the jury and setting an inference for the public that “all” the boxes contained classified documents and were unsecured with the ability of anyone, (guest at Mara Lago), could have had access to them. This is an attempt to get around the defense that the documents were in the locked storage room and that there was constant Secret Service protection at Mara Lago.

Then the only information that is pertinent is a photo of the box showing document, with accompanying photos of the location where the document/box found, (was it in the Trump office or the storeroom or ballroom/bathroom?).

So however did America survive before the PRA was signed in 1978? Presidents were taking stuff home right and left when they left office. Nobody accused them of espionage then. Get a grip, FFS!

I’ve been bringing that up for the last week. Was NARA in on the setup? Why did they decline to help Trump’s minions gather up his presidential documents as they did for every other administration? We need answers! Time to subpoena NARA bureaucrats before the Oversight Committee under oath! 🤬
102 docs marked classified out of 10’s of thousands. These boxes of docs were boxed up by the National Archives and shipped to him.
None of those that did the boxing are charged.
Greg Kelly shows a box as an example filled with 500 sheets in a package of paper and 102 sheets of paper and he shows the many photos of boxes that he says is suppose to put thoughts in the heads of jurors and viewers that Trump has many thousands of classified docs.
BTW Trump can declassify as president any doc whereas Biden could not as senator and VP. He had boxes stores in his home garage and the Penn Biden center which was paid by the communist chinese plus at least a third location. You know they had access. Who packed the boxes And WHO shipped them? GSA? Donald hired a private trucking company? The Archives shipped them - probably never had them? The Air Force moved them?
Where are the box identification labels/handwritten box Id numbers, etc.? As a former contract paralegal and internal company records manager at DOJ, every box that we received or sent out was numbered, addressed and sealed by GSA, DOJ, or for company case records for DOJ case research, fully labelled for internal storage or shipment (by DOJ staff or GSA).
Sloppiness, carelessness, lack of GSA or other govt agency handling, etc?
Could be an important line of investigation as to what happened.
