Is This Proof the Trump Indictment Is a Scam?

As soon as the federal indictment of President Trump was unsealed, we were treated to stories featuring photos of “boxes of documents” stored in various rooms at Mar-a-Lago — including boxes in places like on the stage in the White and Gold Ballroom, and even in a bathroom:


Like the photos from the raid showing classified documents splayed out on the floor, these photos created a certain impression with the public. Just look at how many boxes there are! Look where they were put! Dozens of boxes all over the place, where anyone could get them.

But as Newsmax host Greg Kelly pointed out, it’s “a scam” that’s poisoning the public’s perception of Donald Trump in this case. Why? Because, as Kelly noted, the actual number of classified documents that were found at Mar-a-Lago could fit into one single box, with ample room to spare.

“You don’t have to be a lawyer to look at this and know that it’s a scam,” Kelly said. “Number one, in that indictment, they put some pictures in the indictment to scare us. Ooh, look at all these boxes. The classified documents in the boxes. These pictures are actually in the indictment, and there are dozens and dozens of boxes.”

He continued, “So I went through the indictment and saw that how many documents, classified documents, did the FBI actually recover? 102.”

Kelly then pulled out a box like the ones in the photos. “So, everybody, I got a box right here, alright? This is one box.” He then showed an intact full ream of paper — 500 pages — plus another 100 sheets of loose pages to represent the actual classified documents that were found. They didn’t even come close to filling a single box.

As I said before, when Trump returned 15 boxes to NARA, 14 of them had classified documents. So maybe there was less than a box full of documents, but they were scattered throughout the boxes. Literally any of the boxes in the pictures could have had classified documents, and even Trump didn’t know which ones did. So there was definitely more than 1 box that mattered…

All I have is the knowledge that their case against Trump is not legitimate.

It’s founded on everything contrary to what our country stands for, and it represents a criminal mafia guilty of lying, cheating, stealing, murder and treason.

Were they actually classified or just still marked classified after being declassified? Take the time to watch Robert Barnes eviscerate this bullschiff indictment and spend less time watching the media wing of the Demoncrat party defend this political hit job.

Who wrote that?   The three levels of classification are Top Secret, Secret and Confidential.

The point of the article is relevant.

Even the few scraps of documents they do have amount to nothing.

They have no case, no evidence, so their strategy is to make it look like there are rooms full of evidence.

I assume that is something the prosecutor will try to prove and Trump will try to argue that the statute does not apply to him. A court will have to sort that out, I guess.

They’ll just argue that Trump took far more documents than they were able to recover. Also, 102 documents =/= 102 pages of paper. A 5-page brief stapled together still counts as just 1 document.

If my understanding is correct ( and correct me if I’m wrong ), how the heck is the jury supposed to know if a document is classified or declassified? For that matter, how will we know?

They take President Trump's word as the Chief Executive.   No more needs to be said.   Witch hunt case dismissed.

So, if I understand you correctly, the very act of TAKING THOSE DOCUMENTS OUT OF THE WHITE HOUSE by a President, makes them AUTOMATICALLY DECLASSIFIED?

Law cannot be logically incoherent.

If a president has the legal right to be in possession of documents, he cannot also be prosecuted for such possession.

So how does someone prove a document was declassified if nothing was ever recorded and the markings were not changed? This is why any president just waving his hand and declaring something declassified is a bad idea. If it never is recorded in any fashion, did it really happen and how do you prove it? Trump may be put in the unenviable position of relying on the jury to take him at his word.

My understanding is that Trump is accused of taking documents he did not in fact have a legal right to, but we'll see how this plays out.

So, why indict?

If the issue is about classification, then it has to go through the scrutiny of the courts. A dispute about a document and who owns them need not be a criminal case.

And also, my original question remains unanswered — doesn’t the very fact that the president takes a document OUT of the White House to his home AUTOMATICALLY declassify the document?

Many lawyers ( including many FReeper — just read the posts in this thread ) say so. If this is the case, Trump now holds NO CLASSIFIED DOCUMENTS.

By what written law do we determine whether or not a President has a legal right to take the document? Is it published anywhere?

Having classified markings is not the same thing as presently classified. Tons of declassified stuff still has classified markings left on them.
