Is This Proof the Trump Indictment Is a Scam?

As soon as the federal indictment of President Trump was unsealed, we were treated to stories featuring photos of “boxes of documents” stored in various rooms at Mar-a-Lago — including boxes in places like on the stage in the White and Gold Ballroom, and even in a bathroom:


Like the photos from the raid showing classified documents splayed out on the floor, these photos created a certain impression with the public. Just look at how many boxes there are! Look where they were put! Dozens of boxes all over the place, where anyone could get them.

But as Newsmax host Greg Kelly pointed out, it’s “a scam” that’s poisoning the public’s perception of Donald Trump in this case. Why? Because, as Kelly noted, the actual number of classified documents that were found at Mar-a-Lago could fit into one single box, with ample room to spare.

“You don’t have to be a lawyer to look at this and know that it’s a scam,” Kelly said. “Number one, in that indictment, they put some pictures in the indictment to scare us. Ooh, look at all these boxes. The classified documents in the boxes. These pictures are actually in the indictment, and there are dozens and dozens of boxes.”

He continued, “So I went through the indictment and saw that how many documents, classified documents, did the FBI actually recover? 102.”

Kelly then pulled out a box like the ones in the photos. “So, everybody, I got a box right here, alright? This is one box.” He then showed an intact full ream of paper — 500 pages — plus another 100 sheets of loose pages to represent the actual classified documents that were found. They didn’t even come close to filling a single box.

It’s possible Trump declassified them, but the transcript of the tape makes it sound like he didn’t think he had declassified the Milley document. So if Trump says he declassified them but the prosecution says he didn’t, and there is no record or witness to him declassifying them, how does he prove it? Does he just rely on the jurors believing him?

So you think Trump’s defense should be that he didn’t take any classified documents and that they were planted in the boxes later by persons unknown? Because that seems to be the implication of what you said.

Yes, you can even see written on one of the boxes “MAL Bedroom”. So why is it in the bathroom? Who moved it there?

Per FBI they only found 106 pages of interest to them.

Well, we know that a number of the other boxes did have classified document, over 100 more based on the searches by Trump’s own attorneys and the FBI. So my point stands.

You’ve got it backwards. It’s the prosecution who has a responsibility to prove it wasn’t declassified. The burden of proof is always on the prosecution, not on the defense.

To get a search warrant, you need more than speculation, you need probable cause. The FBI was able to convince a judge they had probable cause to believe that Trump still had more classified documents that he hadn’t turned over. They based that in part on video tapes showing boxes being removed before they could be searched by Trump’s attorney, and by the fact that the boxes that were not removed did have classified documents. Since the search warrant did recover another 102 documents, it seems that they were correct.

Not saying that at all. I'm saying that no one knew there were classified documents in those boxes when they were removed...and it wouldn't have been necessary to have them in a secured area. Trump wanted to go through his "stuff" himself.

And the FBI had "0" right to take any of his personal papers...and that's afforded to each and every one of us under the Constitution.

Hillary, Bubba aka Socks, Biden, Pence and probably 1000 others had Classified files. None were entitled....none were prosecuted...and in fact the NARA told Bubba to keep his tapes. And Comey said no one would ever convict Hillary...and every one says that Biden is a really good guy...etc etc.

True, but all the proof the prosecution has to provide is that the documents are marked as classified, and that there is no record of them being declassified.

Not necessarily. If they truly contained sensitive information, they are not going to publish the details in a public document.

Ok, you have articulated a couple of reasonable approaches the Trump team might take. One problem might be that even after being told about the classified documents, Trump resisted returning them and allegedly took steps to prevent a thorough search even by his own attorneys. As to the fact that others have done as bad or worse, I agree with you, but that is a political argument, not a legal one. Selective prosecution claims are very difficult to win in court.

No....I keep reading it...and finally realize that he is instructing them on how this classification and declassification works and the paper he was exhibiting was purely hypothetical.

As far as a Plan to attack Iran...it goes back a long, long way....way before Trump. We have plans for every scenario we can dream up.

Too bad Biden didn't have a Plan for Afghanistan...his usual chaotic event.....kinda like the LBGHT cr** at the Whitehouse the other day.

If he was trying to deceive NARA, why would he leave the documents that did have the classified documents where the FBI could find them. Removing boxes is not probable cause of anything. He also owned a billion dollar business organization, which could have had boxes full of files, too.

The FBI got a judge to write out a search warrant on the basis of the fact that the judge hated Trump, too, and figured he was guilty of something, and that sufficed to constitute probable cause.

And since they found the boxes that had classified documents pursuant to the search warrant, even assuming he did not declassify them on his last day in office, your argument of probable cause is circular. We found these classified documents pursuant to the search warrant. Therefore, the search warrant was justified.

I found twenty grams of marijuana on the perp by turning him upside down and shaking him. Therefore, my public strip search of the perp was justified.

If he had them, and they were removed before Joe was sworn in...they are hypothetically declassified....and that may be the declassifed by thinking.

In other words, they said they're classified...Trump said...no, they're not...the removal to Mar A Lago was a way of declassifying anything that should have straddled into the thousands and thousands of papers.

Remember, the NARA had "0" knowledge of what he had.

Next question — how did they know Trump did not declassify them? Was there a written procedure a president needed to follow?
