DEVELOPING: Trump’s Legal Team Prepares to File Motion to Dismiss Jack Smith’s Case Citing Prosecutorial Misconduct

Trump’s legal team is preparing to file a motion to dismiss Special Counsel Jack Smith’s case citing prosecutorial misconduct.

Trump’s lawyers will ask Judge Aileen Cannon to unseal Obama-appointed Judge Beryl Howell’s order obliterating Trump’s attorney-client privilege with his lawyer Eric Corcoran.

Via RealClearInvestigations reporter Paul Sperry: Insiders say Trump’s new legal team preparing to file motion to dismiss case citing prosecutorial misconduct & will ask Judge Cannon to unseal Obama-appointed Judge Howell’s order breaching attorney-client privilege b/t Corcoran and Trump and declare notes inadmissible.

As The Gateway Pundit reported, Judge Beryl Howell, an Obama appointee, was first assigned to oversee Jack Smith’s classified documents case and January 6 case against Trump.

Judge Beryl Howell ruled against Trump at every turn!

In fact, Judge Howell previously ordered Trump’s lawyer Evan Corcoran to testify before a grand jury in special counsel Jack Smith’s investigation into classified documents stored at Mar-a-Lago.

Judge Howell flipped Trump’s own lawyer Eric Corcoran into a witness when she obliterated Trump’s attorney client privilege in a ruling.

Howell ruled DOJ prosecutors ‘met the threshold for the crime-fraud exception’ for Trump’s attorney.

Jack Smith used Eric Corcoran’s notes against Trump.

According to the indictment reviewed by The Gateway Pundit, Jack Smith used notes memorialized by Trump’s lawyer against the former president.

Motion to dismiss is pretty much routine.

There is prosecutorial misconduct I’m sure.

The judge will not unseal the attorney client breach though. That’s a pipe dream.

We better hope that’s not their strategy. That stuff is obvious.

We better hope they have a strategy that negates the info in indictment on obstruction.
Which means either its a lie or they need to find a fruit of the poisonous tree tainting.

She was interning for Dickinson Debevoise during the time Debevoise and the DNC were crafting the Forever Steal of the big city plantations.

She's part of the New AmeriCommunist Party apparatus. They probably laugh about it at their Swamp dinner parties.

If you looked at Debevoise's Wikipedia page - note that the most recent Wiki editor didn't add the paragraph about the RNC suit until November 5, 2022 - three days before the latest hijacking of the US Senate by their now finely-tuned national vote fraud machine.

So, if you looked at his Wiki page in previous years [which I did], you had NO idea that he is one of the largest figures in Democrat Party politics EVER.

He basically enabled the subversion of our "elections".

And yet, we have a US Supreme Court decision about this very topic that unanimously and undeniably states the President gets his authority over document classification directly from the US Constitution. Congress cannot intervene. The courts cannot intervene. The power used by Trump comes directly from the Constitution. No mention of that case in the article.

Democrats had accused Republicans of voter intimidation in a 1981 New Jersey gubernatorial race. The case was settled, and the two parties entered into a court-ordered consent decree limiting Republican involvement in any poll-watching operation. But Dickinson Debevoise, the Jimmy Carter-appointed judge who oversaw the agreement, never let them out of it, repeatedly modifying and strengthening it at Democrats’ request.

Debevoise was a judge for only 15 years, but he stayed 21 years in senior status, a form of semi-retirement that enables judges to keep serving in a limited capacity. It literally took Debevoise’s dying in 2015 [at the age of 91] for Republicans to get out of the consent decree. Upon his passing, a new judge, appointed by President Obama, was assigned the case and let the agreement expire at the end of 2018.

He kept the Democrats in the game after 2000, till they finally buried us in vote fraud in 2018 & 2020.

Clever way to scare away lawyers who might represent Trump. Biden doesn't have that problem because DOJ works for him.

Jack Smith going to a DC judge to break Attorney-Client privilege, when he knew the case would actually be tried in Miami, is reason enough to throw out that testimony, if not sanction Smith himself.

That could be appealed (not everything can), but at least something should be done about Smith’s dirty trick. Throwing out the entire case is typically not the remedy, when Prosecutorial Misconduct is alleged. But throwing out the prosecutor, can be an acceptable remedy.
