On Friday’s broadcast of Fox News Radio’s “Guy Benson Show,” author, National Review Contributing Editor, Fox News Contributor, and former Assistant U.S. Attorney Andrew McCarthy stated that while former President Donald Trump does have ample reason to say he’s been singled out, the indictment against him is “a devastating document. If they can prove half of it, he’s toast.” And he believes more than half of what’s in the indictment can be proven.
McCarthy stated, [relevant remarks begin around 35:35] “It’s a devastating document. If they can prove half of it, he’s toast. And I sense that they can probably prove more than half of it, because a lot of it is recorded conversations, testimony from his lawyers, and that sort of thing. So, I think, Guy, part of the reason that he’s been hitting so hard at the idea that he’s being singled out — which he’s got a lot of basis to say that — part of the reason is his real defense here…is the Hillary Clinton precedent. And I’ve had to try to make this point a number of times today, selective prosecution defenses are very effective in terms of trying to argue to the prosecutors that they should not exercise their discretion to charge. Once they do charge, those defenses don’t help you very much.”

I think it’s going to come down to how the jury feels. Technically, it looks like Trump is guilty of at least some offenses. But, there’s no way anyone else would be charged on this crap, and everyone knows it. Will anyone on the jury stand up and say “No!”?

No, but I read the transcript included in the indictment. If the prosecution lied in the indictment, Trump should have no problem getting it thrown out. And please note, I am not accepting it at face value, which is why I said it “appears” to prove those things. The prosecution would need to provide additional evidence, such as testimony from the other people at the meeting about what they were shown, etc. But as I said this seems to be where Trump faces the greatest risk.

Thanks, and I stand corrected after looking up the book title. I guess I had it in my mind that he, like the rest of the NR crowd, said that many non flattering things about Trump (and probably at the start of the Russian affair as well).

Do you really believe they would include fake evidence that would be so easily disproved in an indictment? They would have to get every person in the meeting to agree to perjure themselves on the stand and go along with the fake. The people who are claiming the tape is a fake, or that Trump was lying to smoke out traitors are reaching peak delusion. I’m not saying Trump might not have some evidence to counter the tape, but let’s keep it in the realm of reality, people.
