Andy McCarthy: If Half of ‘Devastating’ Trump Indictment Is True, ‘He’s Toast’ and I Think They Can Prove More than Half

On Friday’s broadcast of Fox News Radio’s “Guy Benson Show,” author, National Review Contributing Editor, Fox News Contributor, and former Assistant U.S. Attorney Andrew McCarthy stated that while former President Donald Trump does have ample reason to say he’s been singled out, the indictment against him is “a devastating document. If they can prove half of it, he’s toast.” And he believes more than half of what’s in the indictment can be proven.

McCarthy stated, [relevant remarks begin around 35:35] “It’s a devastating document. If they can prove half of it, he’s toast. And I sense that they can probably prove more than half of it, because a lot of it is recorded conversations, testimony from his lawyers, and that sort of thing. So, I think, Guy, part of the reason that he’s been hitting so hard at the idea that he’s being singled out — which he’s got a lot of basis to say that — part of the reason is his real defense here…is the Hillary Clinton precedent. And I’ve had to try to make this point a number of times today, selective prosecution defenses are very effective in terms of trying to argue to the prosecutors that they should not exercise their discretion to charge. Once they do charge, those defenses don’t help you very much.”

Except that he can. There is no higher authority than POTUS to determine classification. That seems to have worked for every other POTUS, until Trump.

Exactly. The President is the chief officer of the executive branch. Every department works for him. He has absolute authority to declassify anything for any reason. And he doesn’t have to announce it, and he needs no permission.

The claims made in the indictment are not nearly as damaging as the DOJ hopes they are.

For example, the whole obstruction charge is built around a theory that Trump having some boxes moved from the storage area to where he could work on them was an attempt to prevent his attorneys from finding any classified documents.

The DOJ lista all kinds of texts, phone calls, etc. all of which suggest nothing more than Trump wanted to get some boxes moved to another place.

If Trump was actually trying to obstruct the investigation why didn't he do something like ask for all the boxes with supposedly classifed documents? He did not do that. Instead he asked something like "bring me another 10 boxes so I can sort through them".

The evidence as presented by the DOJ itself shows the opposite of what they think it does. It shows Trump made no efforts to conceal the existence of the documents - which he could have just shredded if he wanted to - but simply that during the process his attorneys only looked at some of the total set of boxes, not all of them.

The indictment is weak, and the facts are not nearly as "devastating" as the set of facts regarding Hillary Clinton and her email server that the DOJ decided would not merit prosecution.

Things that people won’t tell you:

They found Classified Documents illegally in Comey’s house. Comey cited “convenience” when asked about them. Bill Barr said it was a bad precedent to charge a Former FBi Director. Comey also lied to Congress.

IMO, I think the purpose of Hillary’s server was to avoid having compromising information be disclosed by a FOIA request. Her shakedown of people for donations to the Foundation would not look good in public.

But, I agree with you. Obama knew about it and didn’t care.

In Trump's typical style of allegorical speech that does not establish anything. If you recall Trump spent a lot of time talking about making public various documents, and then delayed the process. He called that "declassifying".

But that is different than his legal ability as President to declassify anything he wanted to without any other parties being involved.

There are strong arguments to make about selective prosecution and Trump’s ability to take even classified documents as part of the Presidential Records Act. He might even be able to argue that he declassified most of the documents as President before he left office. I think his greatest exposure is the fact that they have him on tape appearing to show a classified document to people without security clearances and admitting that it was still secret and acknowledging that he could have declassified it as president but could not anymore. That appears to prove that he knowingly shared classified data with unauthorized persons. The PRA gives him the right to retain classified documents, but does not give him the right to share them to others that are not authorized to have access. Unless he can provide some evidence that he declassified the document in question before he left office, his arguments about the PRA and selective prosecution will be irrelevant, at least in regard to this charge.
