ALAN DERSHOWITZ's stunning verdict on Donald Trump's indictment: The ex-president's brag to a writer was 'worst sentence he's ever uttered' and every time he opens his mouth he increases his chances of going to prison

The sensational federal indictment Donald Trump faces has stunned one of the former president's most famous supporters, Harvard Law Professor Alan Dershowitz.

Trump faces 31 counts over claims he illegally-stored highly classified government documents at his Mar-a-Lago country club. Jaw-dropping details of the charges against Trump were outlined Friday - and he faces a lengthy prison sentence if convicted. Trump will appear before a Miami court on Tuesday.

Dershowitz describes himself as a liberal Democrat, although he has previously spoken out against what he sees as the unfair persecution of Trump.

And in an exclusive interview with DailyMail.com, he said the new charges Trump faces are exceptionally serious. The author also warned that the former president's usual strategy of going on the attack could land him in even deeper trouble.

Dersh can go to hell.

I am sooooo sick of seeing him on Bannon's show and see Bannon kiss his worthless Rat ass.

Makes me sick.

Dersh: "Well the Constitution is precious and I am a genius at reading its four pages, and it says this is wrong. But I am a Rat and we are Rats and we are going to do this, you aren't going to stop us, and this is just how it is going to be. Shut up and like it."

Bannon: "OH THANK You, Professor, you are so wonderful. So is your wonderful Harvard Law School. What an honor to have you on our Wayne's World show. Please come back and give us more of your revelations and genius.

Makes me puke.

Here’s Dershowitz’s characterization in the parent article:

Dershowitz: This indictment is stronger than I anticipated in one respect and in one respect only. It has the text of a conversation between former President Trump and a writer in which Trump says: Look, I know these documents that I have in my hand are secret. I could have declassified them. I didn’t. Here, I’m going to show them to you to prove my point. That does seem to be evidence that at least there were some documents that President Trump knew were not unclassified. He had them in his possession.
___________

Here’s some of the exact transcript, assuming all the reports are correct:

https://abcnews.go.com/US/secret-information-trump-audio-recording-talks-declassifying-documents/story?id=99960824

According to a portion of the transcript of the call obtained by ABC News, Trump is heard acknowledging that the document he claims to have is “highly confidential” and “secret.”

“Except it is like, highly confidential. Secret. This is secret information. Look, look at this. This was done by the military and given to me,” a transcript of the audio obtained by ABC News says.

He didn’t screw up. In any other circumstance this whole matter would be negotiated between NARA and Trump. By law it is/was a civil matter. Garland and Co. want to destroy Trump because he knows where the bodies are buried in DC so they went looking for anything they could find and turned it into a criminal matter when they didn’t have to. Obama. Obama and Hillary, etc. have been trying to use Trump to voter up for their wrongdoings as well as keep him from power so they can’t be exposed. That was not Trumos fault. Is he going to make a few mistakes, missteps? Sure, he’s human—superhuman if you ask me because most could not withstand what he has been subjected to.

dont understand why he simply just didnt return what they wanted

He had documents that proved Cross Fire Hurricane was a deep state plot to take him out. The deep state wanted those documents back. Without those documents Trump couldn't prove anything, ergo Trump was reluctant to give them back.

This is NOT about Trump, it is “about” protecting President Biden from Impeachment that is based upon facts/real evidence that are outright TREASON.

“which states any record a setting president takes with him when he leaves office is presumed to be declassified.”

Care to back that up with the actual wording of the law?

Except he didn’t only keep them in a safe. According to the indictment, he kept them in his bathroom and ballroom: https://www.foxnews.com/video/6329102460112

"[I] still dont understand why he simply just didnt return what they wanted">/i>

Because the Presidential Records Act, as well as subsequent court rulings say he can keep it. The PRA was passed AFTER the cited "Espionage Act" was put in place.

The Deep State will put Trump in jail before the election. They will do anything to keep him out of office. The scamdemic proved to them that the American people are just too complacent and comfortable in their lives to revolt. On another front. Why does any president or gov official need gov documents? They shouldnt be in their possession at all. The documents belong to the government and should stay in their hands. We need to pass a law against any private citizen having access to any government documents. This is silly. I had a job and quit it to form my own company to compete directly with the company I worked for. I had been there for 15 years. I had a customer list at home that I used at work. When I quit I simply gave it and all the things that I had in my possession back to the company when I left. That was the right thing to do. It wasn't mine. Why does a president think he is entittled to keep stuff that doesn't belong to them? It is not fair to prosecute Trump and not the others. They should be all left alone or all of them put in jail if what they did was illegal.

“see as president I could have declassified it.

Does not mean he did not in-fact declassify it.”

That sort of stupidity isn’t likely to be on the jury. He admitted he did NOT declassify it while President and it causes him a problem. He wasn’t storing it in a SCIF (or in a regular classified safe). He was acting like they were newspaper clippings.

Hillary did worse, but most juries would convict. If they can back up the recordings and text messages - and I’m 99% certain they can - I’d vote to convict. Wouldn’t enjoy it but my only alternative would be to disqualify myself by telling the court I don’t care about evidence.

“If the tape is true, yes, he definitely did. That’s the whole point of the taped discussion being relevant to the case. You should read the transcript again, or at least for the first time, sounds like.”

Yes, but....lying (or embellishing for effect) is not against the law. And if he was just exaggerating or lying on the tape, it’s a bogus excuse for what they’re trying to do. But we knew that.

How naive of you to believe that we the ppl still have a chance/choice to elect our overlords. The 2020 election proved they can do whatever they want to us. By participating in the folly of thinking GOP elites like RDS or Christie or Scott will be America’s savior, you’re prolonging the division that is currently destroying us. This current course of destruction can only be corrected by removing and replacing our overlords with MAGA personnel. I’m afraid it’ll take revolution and war to make that a reality.

From the indictment

a. In July 2021, at Trump National Golf Club in Bedminster,New Jersey ("The Bedminster Club"), during audio-recorded meeting with a writer, a publisher, and two members of his staff, none of whom possessed a security clearance, TRUMP showed and described a "plan of attack" that TRUMP said was prepared for him by the Department of Defense and a senior military official. TRUMP told the individuals that the plan was "highly confidential" and "secret." TRUMP also said, "as president I could have declassified it," and, "Now I can't, you know, but this is still a secret."

The government seems to be certain that it has the necessary witnesses for event "a." above.

But the government seems uncertain about the date of the event "b." in the following, plus the lack of clarity for "the representative":

b. In August or September 2021, at The Bedminster Club, TRUMP showed a representative of his political action committee who did not possess a security clearance a classified map related to a military operation and told the representative that he should not be showing it to the representative and that the representative should not get too close.

Unless I am wrong, and I might be, but it seems that just by default, any document that President has in his possession is declassified. Since he has the power to do it.

Unless there is some procedure required by Federal law for him to follow to declassify. I don’t know but if I’m on the jury, logic and reason would be big factors.

I feel bad for Trump. He was the greatest President we ever had, or equal to Reagan. His ego may be his undoing. It just didn’t have to be this way. He has done some horrible things to people........attacking spouses like Ted Cruz, attacking DeSantis with no provocation, etc.

I hate to say it....Karma and indeed be a you know what.

In my fantasy land, Trump is acquitted, the nation rallies around him, DeSantis withdraws...(I wish he hadn’t run) and Trump wins by a landslide.

That’s fantasy. Reality might be Trump is convicted and DeSantis is able to win the Presidency.

Only Trumpers can suck it.......all your spin and worship is creepy and bizarre.

Dershowitz is carefully characterizing the case. He didn’t himself say that this is proof. When he says “seems to be,” he is not in fact saying this is actually evidence.

I read the context characterized by media heads and ABC News.

The fact simply is that looking at the words, they don’t in fact say specifically that these documents are still classified. Only that the writer is led to believe by Trump that they are something he has super secret that had been classified.

None of the verbiage in the actual transcript itself admits to the documents being still classified. Trump may have been bragging to the writer, but bragging to a writer is not the same thing as lying to the government.

The words, “Could” and “Secret” can mean such things interpreted in one way, they can mean something else interpreted differently. Ergo, its not an actual admission. I don’t accept the characterization by ABC.

If the PRA states any record POTUS takes is deemed to be unclassified, then who cares what Trump or Garland or NARA says? Trump obviously misspoke. Biden does it all the time and NBD.
