The sensational federal indictment Donald Trump faces has stunned one of the former president's most famous supporters, Harvard Law Professor Alan Dershowitz.

Trump faces 31 counts over claims he illegally-stored highly classified government documents at his Mar-a-Lago country club. Jaw-dropping details of the charges against Trump were outlined Friday - and he faces a lengthy prison sentence if convicted. Trump will appear before a Miami court on Tuesday.

Dershowitz describes himself as a liberal Democrat, although he has previously spoken out against what he sees as the unfair persecution of Trump.

And in an exclusive interview with DailyMail.com, he said the new charges Trump faces are exceptionally serious. The author also warned that the former president's usual strategy of going on the attack could land him in even deeper trouble.

Yep. They ginned up the raid based on National Archive's allegations. But those were fake like most things the government does regarding Trump.

What is the harm done to national security by Trump?

What was the harm done by Hillary, Biden and Pence mishandling classified? Indeterminate, and that is not the threshold for the law.

Again, my only response to your first post was simply that there is no longer a SCIF at M-A-L, and I pretty much agree on the rest. I pretty much agree with this post as well, with regard to the documents at M-A-L. There are some strong precedents in his favor on the documents kept there.

But Trump's holding, discussing, and possibly even sharing classified info at a different resort, that was apparently recorded on tape, is the biggest problem he has, and it's a relatively new reveal. Not only is it unrelated to M-A-L, there's no evidence that Biden, Pence, Hillary, etc, ever did anything similar. The only response that would seem to fly legally would be that Trump was lying when he said it was still classified, which may work, but it's tenuous.

I hope he is able to mount a good defense, and is ultimately proven not guilty, but issues such as these are why I don't think he will have enough broad support to be elected President again.

No, these are President Trump’s personal presidential records so he is entitled to have them. It really was stupid of him talk about it - not because he did aything wrong, but because he gave his opponents a sound bite that they can use against him

There are two redacted markings that are about sources and methods, That means the document contains info on how the imformation about Iran's nukes was obtained.

Yes as Tucker just pointed out, a lot of classification is to protect the deep state. But that doesn't mean the document Trump had wasn't sensitive.

As someone who has been called a Trump cultist on many forums beyond Free Republic, I offer the following.

The tape if authentic is problematic.

Maybe not legally, but when it comes to the political persecution of Trump, what’s the law got to do with it?

Trump dodged a big bullet with the Access Hollywood tape.

And this tape if authentic poses the same problems although that tape was not offered in a court of law just the court of public opinion.

The issue here is not if Trump “jaywalked” which is to say that Trump was in some technical violation of an obscure law.

The issue is the SELECTIVE prosecution of the law.

The illegitimate authoritarian regime can NEVER make the case that somehow whatever laws they accuse Trump of violating were not violated by Biden and Pence and a whole bunch of others not on the public record.

That would simply be preposterous legal hair splitting.

That said the tape if authentic offers every elite on planet Trump to make a case against Trump beyond the preposterous legal case it has brought.

The tape is probably not so legally damaging in the long run, but IF the point of the whole prosecution it to tie Trump up in legal knots for the 2024 campaign, then the impact of the tape will have a significant impact on the campaign.

None of this affects my support for Trump, but it gives me concern for the America First movement which is bigger than Trump.

Just because, I have been called a Trump cultist does not mean that I am.

All this is to say if at some point, I am forced to move on from Trump for the good of the America First movement, I will not hesitate to do so.

The move will NEVER be to the front man for the Deep State and the Evil Media empire of Rupert Murdoch who is presently acting as part-time governor of the Sunshine State in which he has taken out most of the sunshine at least as to how it shines on his travel expenses which likely PROVE he was skirting the laws put in place for declared candidates.

I’ve been there, done that.

I voted for Yale Skull & Boners named George Bush SIX times(twice as VP, and four times as POTUS).

I voted for Bobby Dole who was no happier than when he was cozying up having cocktails with the likes of Washington Post owner Kathryn Graham, Mikhail Gorbachev and Duane Andreas who at the time were globalists of the highest order.

I voted open borders McCain and the smarmiest man on planet Earth Mittens Romney.

NEVER again do I hold my nose and vote for whomever the Republican wing of the Uniparty is marketing like some new improved version of a laundry soap.

There is NOTHING I like about Alan Dershowitz.

It’s not that I am prejudiced against lawyers which I am.

It’s that Lolita Express thingy.

That said, I fear Dershowitz may have a point.

If so, the America First movement must prepared to move on from Trump.

IMHO, the most deserving candidate to move to would be, Kari Lake.

The feds have charged Trump under the part of the statute that makes it illegal to possess material “injurious to the national defense” and fail to turn return it to the federal government upon request.

The Lawfare operatives directed the National Archives to “request” the material so they could make this charge. If Trump can find competent lawyers to work for him, they should subpoena and depose numerous personnel in the National Archives, as well as go after the communications records of numerous government players and their pals. Show that the government created its interest in the documents just to have an excuse to go after him, and some jurors might not be amused.

The killer issue is going to be WHO gets to determine whether documents are or are not a “danger to the National Defense”. In the earlier case about the document seizure, Judge Cannon appointed a referee to review the documents. Appellate Courts ruled that the DoJ could determine this, with no due process for the accused. DoJ will assert this again.

Trump might have a slight chance getting the evidence tossed on the basis of a fraudulently obtained and executed search warrant. The warrant was issued to seek “classified” material; the feds claim they only discovered docs dangerous to national security as a result of reviewing the seized items. That was obviously a set up — they knew what they were after before they started. Trump needs to expose the entire conspiracy.
So as the case progresses, remember that Trump’s Presidential ability to “declassify” documents is not the issue. They have done an end run on that.

I am not sure the Presidential Records Act states what you say it states. I just looked over the text of the act and saw no such declaration. Perhaps I am missing something but I did not see it.

President’s are not supposed to take Presidential records with them when they leave office, they are only supposed to take personal papers.

The laws are enforced selectively and therefore there is no such thing as equal justice under the law.

Don’t take this so called indictment seriously, Trump certainly doesn’t. The only concern I have is if they restrict Trump’s ability to campaign.

Look at the number of boxes and think about how long it would take for him to put it away?

This is pure BS.

He has that same contact information in his head.

This is not about Trump. It is a panicked attempt to prevent Slo Joe and his doubles and their bribe money from being totally exposed. (It already is) And being held accountable.

The blow back from this is enormous. If Trump is president again. 1/2 of DC will be purged. And it needs to be done.

There is no other way to restore the Constitution and right the ship of state.

Well if i were on the Jury i would have to see the document. then verify that the document was the one that Trump displayed to the reporter, then hear the reporter in person with details on his impression of the event. Then Trumps defense. Failure of the prosecution to deliver any of the above would consider the event didn’t happen.

Notice that lawyers on all sides are saying things such as this while continuing to ignore Biden’s bragging that he withheld U.S. funding for Ukraine until a prosecutor was fired. A prosecutor that, by the way, was investigating a company that was paying his son millions of dollars a month.

THAT type of statement by Biden has been continuously ignored.

Nice post. I’ll give a short retort, as I have to leave soon.

There is without question a 2-tiered system of justice. And, this is also without question the biggest problem we face. I, however, along with many others, do not see Trump as the answer to correcting it. While he was in office, he did little to nothing to address it, other than complain, and in fact appointed people into the system that made it worse.

In the case that Trump faces now personally, he is now being accused of things none of the other usual suspects like Hillary or Biden were accused of, due to the release of this tape transcript. Sure, we can call them all even on “mishandling” classified, primarily meaning they didn’t store it properly. Just “mishandling” was enough for Trump to campaign on locking Hillary up in 2016, which he immediately backtracked on as President Elect.

But on the tape, Trump was openly discussing the contents of classified material, and potentially even sharing it, with those without a need to know. This is a wholy different level, if true. Trump is of course innocent until proven guilty, and I truly hope he can prove his innocence in in court, but he seems ill prepared to tackle and resolve major issues as President again, in my opinion. Hope you have a great rest of your day.
