If the head of the joint chiefs of staff does not have a plan to attack Iran, that would be a serious issue.

Look at the first gulf war, Norman Schwarzkopf had a plan to invade Iraq long before we needed to execute it. There should be a plan and it should be refined over time.

I’m not taking Milly’s side, but General Eisenhauer is wearing only his top three awards, which was a custom when I served in the 80’s and 90’s. He earned many more than three.

Looking at a resume, Milley probably looked like a rockstar. Gets interviewed by Pres Trump, says all the right things, knows he’ll have no opposition. And there he is.

Same thing happened with that POS Mattis. The barrel chested Marine freedom fighter. Did you or anyone else think that he’d turn out to be a globalist, leftist POS that wanted to work for Clinton? No.

They’re all liars. Do what they can to get the job, then subvert it the whole time to please their masters.

There is nothing silly about it, old friend — and the U.S. Constitution isn’t “semantics!”

Your Air Force One example is only relevant insofar as the “rules” relate to the limitations placed on subordinates, and on the physical limitations of flying the aircraft. The President can order Air Force One to fly him to Tokyo, but he can’t order the pilot to land the thing on the 18th green at Mar-a-Lago.

The laws establish how documents that have been determined to be classified must be handled, the penalties for mishandling them.

And yet the laws do NOT determine which documents are classified. In fact, the laws explicitly vest the authority to determine classification status to Executive Branch agencies … and the powers of the President can never be subordinate to the authority of those agencies. This is Constitutional Law 101.

… but if Trump did say that he was still retaining classified materials at his home, after leaving office, that he didn't feel he could legally show to anyone else, it clearly blows major holes in his current excuse he had already declassified it. Because if he had declassified it, he wouldn't have said it was still classified, and he wouldn't have been using the excuse of it still being classified as the reason it couldn't be shared.

That’s not the way I understood this narrative. I read this as a potential scenario in which the documents in question are part of the trove of materials that were “re-classified” by Joe Biden after Trump left office. Ironically, this would put Trump in a position where he could potentially be prosecuted for mishandling classified materials just by turning them over to the FBI.

You are utterly and hopelessly wrong. The President can indeed declassify anything he pleases, anytime he pleases, and in whatever manner he pleases.

Those rules are for the minions in DOD, CIA, State, etc. At any instant the President can fully decide that something is declassified.
He does not have to follow the sorority rules of DOD. For example, he CAN issue a clearance for anyone he wants. Also, he does not have to apply for, maintain, or follow the rules of having a top secret clearance.

He can keep things secret from you DOD types. You may not conceal anything from him with a cloak of secrecy if he asks for it.

It’s like that.

A simple analogy is that a President does not have to apply for a clearance, nor can he be denied one. And no person or agency can overrule him on his classification decisions. He does not even have to involve them unless and until he wants to issue them a direct order on the matter in question.

Reagan at one point decided to reveal the capability of a Keyhole Satellite by showing a photo of a Russian carrier. He did it to let them know we could see it all. He deemed that more important than watching silently. Nobody had a right to stop him.

Also, declassifying does not mean he wants to widely discuss the matter. There needs be no announcement etc.

Good summary. Some Freeper (not Golden Eagle) made a bizarre claim a couple of days ago that the President was required to get U.S. Department of Energy approval to release certain information related to U.S. nuclear power.

This statement was ludicrous on its face … as if the President of the United States was subject to the authority of some cabinet official who: (1) is appointed by the President, and (2) works for an executive branch department that didn’t even exist until 1977.

I have never had any military clearances. I have only been subject to confidentiality rules in some of my work for government clients.

You're almost there. You're admitting that even though Air Force One is owned by the Executive Branch, the President still does not have ultimate authority over it. There are many many LAWS that regulate the Executive Branch org FAA, etc, which outline who can fly Air Force One, and where/how they can fly it. You mentioned Trump ordering someone to fly it inappropriately, but that would apply to Trump himself wanting to fly it, without meeting the laws for pilot qualifications, as well. Simply being President and Chief of the Executive Branch does not supersede those laws that govern the plane and its flight.

Likewise, these documents in question are owned by the Executive Branch, but once again there are pesky laws that have been put in place to help prevent that property from being misused. Laws that took the involvement of the Legislative Branch in order to be codified, not just the Executive Branch. As President, Trump would have to right to use, modify, and even change the classification level of the documents, but only within the confines of the existing laws that protect them. At least legally.

He would be and is subject to the laws that govern Executive Branch property. Laws are not purely an Executive Branch construct, the are a joint construct of both the Legislative Branch, and Executive Branch, to govern all members of both parties, where applicable.

Admittedly there are laws regarding special powers of the President to declassify, but there are legal processes within that authority that must be executed. Again back to the Air Force One example, the President has special authority over AF1, but he does not have ultimate authority to do anything he wants to with that piece of property, legally, if those desires are outside the laws that govern it.

I read this as a potential scenario in which the documents in question are part of the trove of materials that were “re-classified” by Joe Biden after Trump left office.

We'll have to see when more reports come out, but my understanding is the interviewer was digging into a disagreement between Trump and Milley, after Trump had left office, and Trump said something along the lines of "I have a classified document at my home that proves Milley is lying, but I can't show it to you because it's *STILL* classified."

I'll admit, until I hear the audio, I'm not assuming that is what is on the tape, as the media has been proven to be more than willing to lie. My only point is if that is what he said, it undermines the current defense he's put forth in the press, significantly. Thanks.
