Texas Senate passes bill allowing state law enforcement to arrest illegal migrants

The Texas Senate has passed a bill authorizing Texas law enforcement officers to arrest foreign nationals who’ve illegally entered Texas from Mexico.

SB 2424, which creates a state criminal offense of improper entry from a foreign nation, filed by Sen. Brian Birdwell, R-Grandbury, passed the Senate along party lines by a vote of 18-12.

Birdwell argues the federal government has abrogated its duty to enforce immigration law and “Texas had to fill the gaps.” However, he also said in a statement, “Texas peace officers would not be enforcing federal immigration laws, but rather a new state-level crime created by the bill: illegal entry into Texas from a foreign nation.”

The bill would create a new offense, “improper entry from foreign nation,” in state penal code. It clarifies that those committing the offense are an illegal “alien” who “enters or attempts to enter this state from a foreign nation at any location other than a lawful point of entry; eludes examination or inspection by United States immigration officers; or attempts to enter or obtains entry to this state from a foreign nation by an intentionally false or misleading representation or the intentional concealment of a material fact.”

> No people...or goods...getting in. I’ll do without avocados!

for the last few years I’ve been saying, half seriously, that I’m not going back to Mexico unless I’m at the head of a conquering army.

I think Avocados are a good enough cause. Ever since the Cartels have started screwing with the supply with oppressive tactics, they’ve ventured over the line.

“¡Liberación de aguacate! ¡Libertad para el aguacate!”

Nixon wing of Law n Order Republicans are the problem. Prior to Nixon, it was standard for local law enforcement to enforce illegal immigration. When an illegal immigrant was drunk and disorderly, not supporting his family, or any form of undesireable, local government collected them and when they had collected a bus load (or traincar load in the old days) they would send the bus south. They did the same for undesireable Asians and Europeans, escorting them to a forced boarding of an airplane.

Nixon changed that, emasculated local law enforcement, made them dependent on federal money and agenda, and centralized law enforement.

Nixon is the biggest mistake the US has made in my lifetime, bigger than the more recent mistakes.

Yes! Finally!

Not so fast, what does the state of Texas plan to do with them?

They have no authority to send them back to Mexico if they refuse to go voluntary. Mexico will not take back anyone that is not a Mexican citizen.

If they turn them over to DHS they will just release them.

So the only thing this provides for is incarceration. That's going to be really expensive and wile it may give a added level of deterrence it really does nothing to solve the problem.

The best that can be hoped for is that the smugglers move their operation out of Texas to other states but since they're well established in the border towns that is unlikely.

Sorry to be the conveyor of sad news.

It’s a step in the right direction.

Better paying to keep them in prison than paying for them to live in and commit crimes in my town.

Also, I think parachuting them into their countries of origin or DC is worth a try.

:-)

Recent court decisions - Arizona got smacked down by the Supreme Court a few years back for attempting to enforce Federal immigration law with state and local law enforcement. I.E., only the Feds can arrest someone on Federal immigration charges.

This creates a *state* offense of illegal entry, which has no Federal entanglements and which state and local law enforcement can use.

Not so fast, what does the state of Texas plan to do with them?

Texas passes a law to lock up the invaders. The feds sue immediately and it gets expensive too. But meanwhile they are in jail a month. If Texas tries to deport them after they are released, A fed judge rules that the Constitution grants that power to congress. Never mind that Mayorkas is letting them all in.

As long as Biden or another Dem is in the WH and the people don't make them behave (Replacing Mayokas: even if Biden gets rid of Tweedledum he will appoint Tweedledee).

I still like the idea of a head tax on illegal resident aliens. They won’t pay it, of course, but would allow the state to seize property and wages.

I wonder if illegals shipped here by Biden can be arrested as well.

Texas leads the way.

Gonna need more law enforcement. Texas Citizens should report every illegal the run across. Time to shutdown this ruination of our great Republic.

I wonder .... how Texas will pay for this. Maybe ... other states will kick money their way to help out? After all, the benefit would be nationwide.
Another thought: What if the illegals come in through New Mexico? And then go to Texas? Or was this also covered?
