Fox News settles Dominion defamation lawsuit
NBC ^ | April 18, 2023, 4:01 PM EDT | Jane C. Timm

Fox News and Dominion Voting Systems said Tuesday that they have reached a settlement agreement just moments before opening arguments were set to begin.

The deal ends a monthslong legal battle over whether the media company had defamed the voting machine maker when they broadcast election conspiracy theories in 2020.

The terms of the settlement were not immediately available.

Dominion sued Fox News in 2021, demanding $1.6 billion in damages. They said the network defamed it when it broadcast baseless claims that it was tied to the late Venezuelan President Hugo Chávez, that it paid kickbacks to politicians and that its machines “rigged” the 2020 presidential election by flipping millions of votes for Trump to Biden.

The settlement came on the day trial was scheduled to begin; late Sunday, the court delayed the conclusion of jury selection and opening arguments to Tuesday morning, leading to speculation that settlement talks could be taking place behind closed doors. The announcement follows a bruising week for Fox News. During pretrial conference hearings, Delaware Superior Court Judge Eric Davis sanctioned them for withholding evidence, admonished them for not being straightforward with him, and said he was considering appointing a special master to investigate possible legal misconduct by the attorneys. He said he would allow Dominion to conduct an additional deposition with Rupert Murdoch at Fox’s expense.

Davis also ruled that Fox lawyers could not use newsworthiness as a legal defense, limiting their possible trial strategies.

Few defamation suits make it this far, but legal experts say the case — and the extraordinary claims and evidence fueling it — was unique.

Legal filings made thousands of pages of emails, text messages, and other communications public, revealing that Fox News journalists, hosts, and executives knew the bogus claims about the election were false, even as the network continued to put them on air.

Well, there was a big push by the Trump administration to make sure that the results could be audited.

In the 2016 election, I think the percentage of machine votes backed-up by a paper ballot was around 80%. Trump administration (working with the individual states) made a big push to get that number to be much higher.

And my understanding of the “actual malice” standard is that if you’re going to publish/broadcast the claims made by other people you cannot disregard whether or not said claims are true.

Well that can't be right, because if that was true, all the mainstream media lie machines would have been sued out of business.

The Judge was bought and paid for. So when does Trump get to sue the Washington Post and MSNBC for all of their lies? Fox is guilty because the Judge threw out all of their defences.

Yeah, I saved it. It was so outrageous that I *HAD* to save it. Also, I’m pretty angry that Powell decided to bring Smartmatic (whose sole involvement in the 2020 election was in Los Angeles County, CA) into the whole mess.

Powell has ZERO credibility. I thought so before but now—HERE’S THE PROOF! Who gets their evidence/proof of anything from a woman who speaks to the wind and who has been “internally decapitated?”

Though I admit, “Wind Lady” didn’t specifically say that the wind told her about the algorithm. “Wind Lady” claims to have figured that one out all by herself.

I guess we'll see. Maybe today everyone has a laugh at Wind Lady, but tomorrow her words are considered prophecy!

Everyone laughed at Mike Lindell when he explained that China was flipping votes via an underwater ISDN line, until he showed up with the actual Packet Captures. The FBI, NSA, CIA et all couldn't be bothered with the Truth, but Mike knew if there was some crack in the pipe he'd be the one to find it.

That sounds good on the surface doesn’t it?

I read a report in the last day or two: “Legal experts” saying that PDJT’s filing suit against his former attorney Michael Cohen may have been the most reckless thing he’s done—because discovery may open up a whole can of worms.

Something to consider.

Mike Lindell hasn’t proven anything.

In contested states 100% of all votes cast by machine produce an auditable paper back up.

That’s something that President Trump’s administration put in place to guarantee election security.

Not really.

Historically, it has been VERY difficult to PROVE that a party has acted with disregard to the truth.

This particular case seems to be quite the exception.

He never produced any actual packet captures. IIRC he claimed that Dennis Montgomery had the data. Here’s a Twitter thread from a computer expert who attended Lindell’s symposium.

What does proof have to do with anything? It's Delaware. It's an automatic loss for anything the hive mind doesn't like.

The same thing would happen in any trial in Washington DC, Portland, San Fransisco, Boston, etc.

It's crazytown and I wouldn't be surprised if the jury would award a trillion dollars in damages.

Seems like nobody could interview anyone, then. And how would they know the claims are false?

as politicized as everything is nowadays?...with a jury in Bidens home State??..with a Trump hating Judge?. Would have been suicide...settle it, admit to nothing, and move on.

$800 million settlement?!?! What a bunch of saps at Fox News...Dominion was not even worth 1/10th of that amount. The executives at Dominion are making out like bandits and Fox News lawyers took the corporate lawyerly way out.

Fox are a bunch of cowards, cucks, neocons, and rinos. They cowed down when B. Hussein Obama threatened their freedom of the press. They treated Yeb Bush like some kind of “front runner” during the 2016 campaign, right up to the point he dropped out.

I discovered Free Republic while searching for something more rock ribbed and less milquetoast than the “arch conservative” Fox, by the way...

Wrong! In Day 3 Lindell was able to finally break through the hackers jamming his signal and transmit the packet captures. That news was unfortunately somewhat overshadowed by his violent assault by Antifa a few hours later.

I see a trend when Absolute Proof is produced that the Lame Media just ignores it. For example, where are the Cyber Ninjas now. They beat the system, exposed the AZ Fraud. Just last season's winners basking in the Maui sun while the proof keeps adding up.

But with this settlement the fraud has been fully shown as Beyond Suspicion.
