AUSTIN (KXAN) — The trial for Daniel Perry ended Friday, and after jury deliberation, he was found guilty of murder for the death of a man during a 2020 Black Lives Matter protest.
Perry faced one count of murder and another count of aggravated assault with a deadly weapon after the deadly shooting of Garrett Foster in the streets of downtown Austin on July 25, 2020. While he was found guilty of murder, the jury found that he was not guilty of the aggravated assault charge.
Austin police report from July 2020 incident According to APD’s description of the incident, a car turned on Congress Avenue near 4th Street at 9:51 p.m. into where a group of protesters was marching against police violence. Protesters surrounded the car. Foster was armed with an assault-style weapon and was one of the protesters who surrounded the car.

Foster never fired a shot. Another protester then shot at the car three times but did not hit anyone.
Perry and the other shooter were detained by police after the incident. Audio from Perry’s 911 call and video from his interview with APD were played during the trial.
Recap of the trial During the trial’s opening statements March 28, the defense argued Perry had to defend himself after he was swarmed by protesters. Perry, an Army sergeant, came in contact with the protesters after traveling to Austin from Killeen to drive for Uber for supplemental income.

Opening statements in murder trial of man accused of shooting, killing protester in Austin Daniel Perry trial day 2: Fiancée of killed BLM protester testifies Murder trial: Expert says Daniel Perry slowed down as he made turn into crowd of protesters Daniel Perry murder trial almost over, attorneys prepare for closing arguments Opening statements from the state revealed Foster was a frequent BLM protester, and prosecutors said he was protesting nearly every day that summer. The state argued Perry incited the crowd, causing protesters to respond by hitting and kicking his car, and also screaming at him.
According to state prosecutors, Perry openly discussed his anti-protest feelings on social media. They said he had a conversation with a family friend a few weeks prior to the Austin BLM protest on July 25, about a protest in Seattle, where a driver drove into a crowd and killed a protester. Prosecutors said in this conversation with his friend, Perry agreed someone could and should claim self-defense even if they incited a crowd.
Perry’s defense said he did everything he could to avoid the protesters as he dropped off one of his riders downtown. They said he was fully cooperative with police and turned over his phone and social media passwords right away, without a warrant.
The state argued Perry sped into the crowd of protesters, though that was disputed by the defense’s expert witnesses who used science and data to track the speed of his car. The expert testified he was slowing down when his car entered the demonstration.
The defense and state both rested Wednesday afternoon. During the trial, nearly 40 witnesses were called on to testify. Closing arguments were given Thursday before jurors began deliberations.
Jurors concluded their deliberations Friday evening.
Austin Texas I presume? He never had a chance. Same crap goes on here in New York. Last Wednesday a Judge let a killer out NO bail after he killed a 15 year old kid, and not only that, the ‘judge’ ripped the VICTIMS mother!

Yes, but Texas still has a red governor (for now). He needs to take care of this.
He didn’t drive there deliberately. He was driving for Uber and whole on his route was surrounded when he turned down the wrong block.
The byrd is the word.
Free as a bird and still serving the peoples on dc, just us served up.
Trump's only hope is on appeal. The jury has already found him guilty.
Yes, I understand that the jury hasn't even been picked yet but it doesn't matter. It'll be twelve unapologetic anti-Trump partisans who won't even bother to disguise their hatred towards the president.
“BE EXTREMELY careful what you post on social media.”
Most of us who have posted on FR are probably done for if we get into a similar situation.
“BE EXTREMELY careful what you post on social media.”
/\THIS!/\
If you don’t think posts will be used to get search warrants or in your prosecution when the time comes, you are very naive. Even the stuff posted here, often in jest (boating accident).
Then he needs to get a change of venue. Blue county jurors have a documented history of being bias and stupid.
There was video posted here at FR after this event that showed defensive shooting when the actor aimed a rifle at the people in the car.
“BE EXTREMELY careful what you post on social media.” I am sure that my snarky comments on Freerepublic can get me into all kinds of trouble with the alphabet boys. Something to think about.
This Perry thing is a true witch hunt style travesty of justice IMHO. Just gross. I’d suggest letters to Abbott over this one.
The way I see it, if it comes to that point, we are in a lot of big trouble, anyway.
RE: That is Austin. As blue as New York City.
As the song might have said:
On a clear day
you can see the corrupt bias
trying to pass for “justice.”
Judges can now ask “What does the guilty white defendent plead?” as scowling, hateful jurors get impatient to find the person guilty.
Heard in person: “People are so stupid now. Aren’t there some out there who have enough brains to know Trump has been a crook all along? He’s finally starting to get some his punishment.”
I did not deck him. Waiting for appropriate reactions to future matters.
Greg Abbott must pardon this individual. Serial injustices inevitably will lead to vigilanteism. Destroying the justice system will have consequences. Republican had better act now.
There is no justice in the USA. An innocent man is in a car which is surrounded by a mad pack of savage subhumans. He fires to protect himself. He is arrested and convicted.
He had the right to kill them all. He was unjustly convicted.
Austin is a liberal city. It doesn’t belong in Texas.
The Governor has limited powers in Texas. The state RR Commissioner has more power. Not sure if either can help in this situation.
It was clearly a case of self defense, but it happened in Austin, so normal laws do not apply.
We are in a civil war, folks and government is the enemy.
Go for it.
