“Influencing the election” or not, is NOT the matter, when no underlying crime is committed, and a financial arrangement to not publicly talk about something (”an affair”) that was not illegal in the first place, is not a crime. There was no crime that was to be “covered up” by the “hush money” (particulary when the affair was a very well known “secret”). If that were a crime, then politicians could not spend a dime of their own money on anything that might “influence an election”.
