Houston police are asking a bystander who shot a man 9 times and killed him while he was in the act of robbing people inside a Houston restaurant to come forward for questioning. FOX 26's Gabby Hart spoke with local criminal defense attorney Price Brown about if the incident could be considered self-defense.

Kid falls in store, husband rolls up on him and tells him to not move and he moves......puts 3-4 rounds at point blank into his ear. Looks like coup de grace.
DA/LEOs interviewed him (WW2 and Korean war vet) and video tape showed wife yelling at husband "hes got two guns! ones in his belt!". NO bill. No charges, no riots. He was in fear for his life...kid already tried to murder her and he was still a threat.
Turned out it was a 15 year old dindu who had come into that convivence store since he was in diapers.
Couple of years later, his brother robs Sims BBQ after his Mom got off work....that jerk got killed by the owner too.
Roy Rogers had this deal he used to do where he’d shoot the gun out of the bad guy’s hand and then give him a good talking-to.

Yeah...that’s pretty bad. The guy must be former military.
Yes, it clear this guy went beyond “defending himself and others”. The final, very much delayed and shot to the head, makes it impossible, as far as I can see, under the law that this guy isn’t going to face charges... and yes the throwing his coffee on the body adds to this.
There is no doubt in my mind he’s going to face charges, if he is identified.
However, as I said, even with those things if I was on the jury, if the prosecution didn’t show me a pattern on past behaviors that made this guy look like a general societal threat, I personally would not vote to convict him.
This could be nothing more than this guy just snapped a bit in this situation, and went well beyond defense... Or it could be this guy has a history and this idiot perp just ran up against a guy with way more issues than he had.
It’s clear from this clip, this went from a defense of people and property to a flat out execution. The guys gonna face charges over it if he’s identified, which given they have his face, and truck on camera, will almost certainly happen at some point.
Cops/DA can say publicly all day long that they aren’t charging him with anything, but believe me, he’ll face charges under the law for this.
This clip is far from clear. There is no way to tell if the perp was moving at the time of the head shot or not. However, he was within a foot of him, with a much better view.
Like you, I would not vote to convict.
Yep, there is no way this is just defense of self and others.. that head shot makes this an execution, no way he won’t face charges once identified, I don’t care what the DA/LOE are saying their public interviews.
Threat was neutralized.
Apparently his atty has contacted law enforcement. So he’s lawyered up.

The head shot is what is going to get this guy in trouble.
Also him throwing his drink and cup at the dead body afterward is not going help.
He’s facing charges for it.
Unless they could show me this guy has a history of behavior that would make me think this guy is a threat to society in general, I wouldn’t convict him for killing this man regardless, but there is no way he’s not facing charges.
Yep that final shot to the head took this from defense of self and others to a summary execution.
And dumping his cup of water on the corpse and throwing the cup at it as well as he walked out isn’t going to help his case either.

If the shooter is a gang member or an illegal, he won’t spend a day in jail. Houston’s DA is a hug-a-thug type. She turned out a cop killer like handing out candy.
NOT being a “Professional” in determining ‘when the threat is over’-—I am keeping ALL the customers safe.
NONE of us are “Professionals” in knowing ‘when the threat is over’.
I would rather err on the side of caution-—and BE SURE.

Not so sure. I read yesterday that the shooter left the scene in a 1970s era pickup truck without a bed. Not sure what kind a cars cartel members drive in Houston, but where I live in the Northeast, the car of choice for gangbangers is a Mercedes or similar status car.
Some yes. Lower end soldados, no. And more than a few are in the gangs that nibble at the edges and do courier, and enforcement work here and there.
That looked street. At a bare minimum, local gangster.
You are free to err all you like, but if you do like this guy did, you will indeed face charges.
