Houston police are asking a bystander who shot a man 9 times and killed him while he was in the act of robbing people inside a Houston restaurant to come forward for questioning. FOX 26's Gabby Hart spoke with local criminal defense attorney Price Brown about if the incident could be considered self-defense.

Shot him 9 times. Too bad he didn’t have a spare mag, coulda been 18 times. MF’r got what he deserved.

No it is a taqueria in the 6800 block of South Gessner Rd.
“You gotta be handy with the steel, if you know what I mean, earn your keep.”
Summary: shooting him the first few times, until he was down and not moving, was legally OK.
Shooting him AFTER he had taken the gun away from the downed robber, was a bad move.
Heat of the moment. But, perhaps also why he left the scene.

Here in Missouri we can use firearms in defense of others in imminent danger. Doesn’t TX have laws like that?
No, Castle Doctrine. We can defend ourselves and others. Made sure the robber was dead, dead, dead. I can shoot somebody stealing my car or my dog under Texas law.
Saved us taxpayers the cost of housing and prosecuting the criminal.
