Montana residents this week appeared poised to vote down a proposal to give all infants born in the state the legal protection of personhood, one of several pro-life measures that sputtered at the polls during the midterm elections.
The measure, Montana Referendum No. 131, was polling at 52% opposed with more than 80% of the votes tallied on Wednesday afternoon. The Montana news website YourBigSky on Wednesday reported that the measure "was defeated by a 4% margin," though it is unclear if the total votes have yet been tallied.
The referendum, if passed, would have enacted a state-level "born alive infant protection act" that would have established "an infant born alive is a legal person for all purposes under the laws of the state and is entitled to the protections of the laws, including the right to appropriate and reasonable medical care and treatment."
“In the absence of proper legal protections," that bill argues, "newly born infants who have survived abortions have been denied appropriate lifesaving or life-sustaining medical care and treatment and have been left to die."
The bill declares that healthcare providers who violate its personhood provisions would be "guilty of a felony and upon conviction shall be fined an amount not to exceed $50,000, be imprisoned in a state prison for a term not to exceed 20 years, or both."

Yes...let’s start killing delivered babies. Makes a lot of sense.
Used to be Montanans could be relied on to do what is right.
Not so much now . . .
And this is MONTANA!
Supposedly a Red State! 😔😢
Infected with Californians...
I always thought that at birth, an American baby has all Constitutional protections. Apparently not ... at least in the sick, evil minds of abortion enthusiasts.
N O doubt our founders are rolling over in their Graves at how wicked this nation has become
RE: Infected with Californians...
Infection always move from blue to red states, never the other way around! 🤔🤔
Except I can remember when many on FR thought Florida would be a lost cause because of so many from the Northeast moving down there...
Well, almost never. I would say Florida is the exception.
Were people afraid that babies born too prematurely to survive, or with fatal defects, would be aggressively treated and resuscatated, rather than allowed to die peacefully in their parents’ arms?
The bill did say “appropriate treatment.”
Or did the “women are entitled to a dead baby” contingent have an honest victory?
It was advertised as an attack on doctors.
RE: Were people afraid that babies born too prematurely to survive, or with fatal defects, would be aggressively treated and resuscatated
And why would descent people be afraid of that?
I believe this law was drafted NOT primarily with prematurely born babies in mind, but with babies who survive late-term abortions.
There have been too many cases of infants surviving abortion who were simply abandoned, ignored and left to die without care because their mothers don’t want them.
America will be judged - and found wanting.
RE: it was advertised as an attack on doctors.
It should be advertised as a law telling doctors to DO THEIR JOBS.
How many churches in Montana? A few dozen?
Face it. This election demonstrated the disgusting values that a near majority of the American people now hold. The unrestrained barbaric killing of pre born human life and easy access to mind altering marijuana far outweighed inflation, economic decline, crime, energy shortages and demented corruption as a motivation to elect Democrats. The people of Pennsylvania are now beyond the pale having elected a demented, viscous, marxist barbarian to the US Senate. Sorry but there no longer exists a common consensus of values to unite Americans. America is rotting from within.
Iowa has an all Republican congressional delegation.
Ohio is moving from a toss-up state to a red state.
Of course there is Florida.
It’s becoming clear where the dividing lines are and how the country may (will, eventually) break up.
So, is there an age limit on retroactive abortions? Asking for a friend.
But, an illegal alien can give birth to a ‘citizen’ the moment it comes out. Interesting.
Montana was trending back to the Right, can’t imagine that the liberals in Bozeman, Billings, Kalispel and Whitefish have the numbers for something like this. Wonder how many college kids were voting.
