Kash Patel: All The Documents At Mar-a-Lago Were Already Declassified Unilaterally By President Trump (video)

Former Trump national security staffer Kash Patel called in with Martha Maccallum on FOX News on Friday to react to the release of the warrant used by the FBI to search President Trump's Mar-a-Lago resort home.

"If he says something is declassified, that's it, it is declassified," Patel explained. "He declassified a whole set of documents that should have come out... That's on the National Archives to sort that material out... Even if it was classified, they'll never meet the burden of intent because the president didn't pack it up and take it out himself, the G.S.A. has said they did it and they made a mistake."

I'm pretty sure that you have to keep any classified documents that you have, especially if you have no legal right to have those documents in your home, on an email server in your bathroom.

All any President needs to do is say, these documents are declassified. End of story... period. The President doesn’t need to write it down, he doesn’t even need to tell anyone. If the President says it’s declassified... move on, no story here. There are no clear procedures for the President to Declassify anything.

So all he has to do is "say it", but he also "doesn't have to tell anyone?" That's just dumb because there's no way to know whether the hell he said it or not while president.

Realistically, he's gotta write it down and sign it, but I'd guess he likely did do that anyway.

According to Brett Baier on Fox, Trump cannot just “wave a wand” and declare papers declassified but there is a process that has to be followed with a paper trail.

I was listening to Never-Trumper Rich Lowry's National Review podcast driving home from work today and even he, and his fellow podcast hosts, concede that there are no set-in-stone procedures for how a president must declassify documents and that in doing so would make the president answerable to a higher authority in regards to declassifying documents.

The president can, quite clearly, wave a wand.

Now, if it is decided that this power needs to be restrained and allowed only after certain procedures are followed, this would require congress to pass a law.

Congress has not passed such a law.

All the hosts pretty much conceded that if President Trump said he declassified all of those documents, then he did exactly that.

And these folks ARE NOT fans of President Trump.

They received their talking points from the government. Seriously, why does anyone at FR care what Baier says about anything Trump-related? The guy is a Never Trumper on the scale of Chrissie Wallace.

The Rats have made impeachment meaningless.
Because of that no one will think you’re standing on principle, it will be viewed by most as more political theater. I prefer to be effective with my actions, not pat myself on the head and say “What a good boy I am!”.

The government delivered these docs after Trump ordered declassification. If there is an issue, it is on the government derps that were asked to do their jobs. Trump's people didn't just walk in and throw a bunch of documents into boxes.

yeah that is how it works, if he said it its done, there is NO way to prove otherwise, he doesnt have to do it in front of witnesses, doesnt have to write it down, just has to say “Yeah I declassified it” and end of story done deal..with Hillary Clinton, she never had that authority since she was secretary of state only a president can do that

I think the reason for this confusion is that there is a process that is supposed to happen after a President declassifies something. That includes publicizing the declassification in the federal register, etc. That's stuff is indeed supposed to happen.

However, those subsequent steps are not the actual declassification. The declassification is the presidential determination that the information is declassified. The post-determination process for dissemination of that decision regulates how others in the government are supposed to treat those materials.

Baier's argument would mean that it isn't the president who declassifies information, but rather his subordinates. And that doesn't make any sense.

That is not something that probably works in today's hyper-partisan climate.

Art. 2: "The executive power shall be vested in a President of the United States of America."

Congress cannot pass a law limiting the power given to the President by the Constitution. Lower executives cannot create a process limiting the constitutional authority of the Presdent.

Who is empowered to create a process telling the President what hoops he must jump through to exercise his constitutional power? ALL executive power, including classification authority, is vested in the President. Powers exercised by lower authorities are derived from delegation of power by the President. The President is the highest authority on classifying and declassifying, not some executive committee exercising powers derived from the President.

I believe calling out a rat is calling out a rat. The case for Biden being corrupt is so demonstrably provable that if it was presented to the American public, it would be uncomfortable to Senate Dems not to remove him from office.

With the American public seeing what a piece of sh*t he is, the Dems will look like they are doing the political thing in protecting him.
