Large trucker protests over California’s gig worker law AB5 shut down Port of Oakland terminals

The Oakland International Container Terminal (OICT) management closed operations on Wednesday at the Port of Oakland due to the independent trucker protests over California’s gig worker law, known as AB5.

The Port’s other three marine terminals are effectively shut down for trucks as well, the Port of Oakland told CNBC, while there are some vessel labor operations underway.

This is the third-day truckers have protested California’s gig worker labor law, which was sparked by the rise of gig economy platforms like Uber, Lyft and DoorDash. A two-year legal stay was recently lifted when the Supreme Court decided not to hear a case which would have protected truckers from the impact of the law.

AB5 requires companies that hire independent contractors to reclassify them as employees, but there are some exceptions in the law across industries. The majority of truck drivers in California are owner-operator and many in this job category are concerned about their future. An estimated 70,0000 truckers who own and drive their own trucks would fall under this law and they do not want to become an employee or part of a union in order to work.

One of those protesting is Bill Aboudi, owner of AB Trucking. “So far there has been no contact with the governor’s office. It seems the governor is not concerned about taking American workers’ rights away,” Aboudi said. “These are independent, small businesses that choose to operate their own trucks, and now that right is taken away from them. They do pay taxes, they do have insurance. It’s their choice to do that.”

Why in the world would the voters of CA let the gov’t set wages and benefits? Don’t they realize this will raise the price these independent drivers have to charge?

Yet another example of leftists ramming forward their agenda, consequences be damned. The Legislature could.. even temporarily… suspend the law. They have no interest in doing so

Truckers are a different breed. Even the drivers with the big companies chose the trade because they prefer to be independent and not have a boss looking over their shoulder all day. I drove for Werner and like most drivers with the big companies, I wouldnt take a load that has the potential for violence at either end or in between. If this thing gets hot things will get fugly fast. So far American truckers have been well behaved.

Most probably don't. Much like believing the "magic" that electricity is unlimited at an outlet (despite the numerous power outages - SMFH), most have no clue of the costs to develop, produce, and transport product to their local stores.

How about just the Pacific coastline? California has some valuable Central Valley farmland (being mismanaged by the state) that the rest of the country would be able to utilize.

Was the original reason for this dumb law to force Uber, Lyft and the various delivery companies to hire their drivers rather than contract them? I know it swept up various writers, artists and engineers who worked independently but had more that the small number of allowed jobs (maybe it was 6) per year for companies. If you wrote a monthly column for a magazine or website you would have to be an employee for than company rather than a contractor.

It was a dumb law for everyone and I am glad the truckers didn't get an exemption. Kill the law entirely rather than exclude a few groups who can cause trouble. Sometimes The best way to kill a bad law is to enforce it on everyone.

Yes, it was intended to make sure gig workers would make at least minimum wage in California. Basically enforcing the ABC test which really is Federal Law.

An individual performing any service shall be considered an employee and not an independent contractor, unless—

the individual is free from control and direction in connection with the performance of the service, both under the contract for the performance of service and in fact;

the service is performed outside the usual course of the business of the employer; and

the individual is customarily engaged in an independently established trade, occupation, profession, or business of the same nature as that involved in the service performed.

What this means is that a worker providing services is deemed an employee (and not an independent contractor) unless they meet all three of the ABC prongs. Conversely, if they meet all three prongs, they are deemed an independent contractor, not an employee.

Most of these people, truckers included, fail the second aspect of the law. Uber, Lyft, WAG attempted to evade this by claiming they were a software company. Others that have traditionally been considered ICs got caught up in it. But truly the Federal Law should be employees.

If they really want to make a point, they need to Shut Down ALL Access to Sacramento for 2 weeks, especially Truck Deliveries.

If you’re working, you’re not retired. You may have retired from a previous job, or even your primary career, but you’re still in the workforce. When I retired, I stayed retired. I have zero interest in ever collecting a paycheck again.
