House Republicans eye 15-week federal abortion ban

The GOP is considering a 15-week ban on abortion following the demise of the constitutional right to the procedure, according to influential anti-abortion legislator Rep. Chris Smith (R-NJ).

Smith is the chief backer of the Pain-Capable Unborn Child Protection Act, which would outlaw the procedure after the 20th week of pregnancy. But Republicans are expected to shorten the deadline for obtaining an abortion still further, Smith told CNN.

THAT is what the SUPREME COURT just said.

The Supreme Court said it was up to the people's "elected representative's. Nowhere does it say it's strictly a state matter, and under the Commerce Clause Congress may well have the power to impose a single, federal solution.

The way the GOP works ... this is what to expect out of DC ... they will propose 15 weeks ... the demonkraps will propose 2 days after birth for health of the mother. The final bill will be before anytime before 5 cm dilation. The GOP will claim victory ... say there are no winners here... but they prevented the killing of a newborn baby. And any state that doesn’t agree to this standard, will have their Medicare funding cut by 50%.

Abortion is not a Federal issue. Its a state issue.

Nowhere in the decision does Alito make that case. He refers to it as a matter for the people's "elective representatives" so that could be state or federal. Right now there are calls in some states for a single solution for all states.

Most politicians find the Constitution’s preamble to hard intellectually to understand. You expect them to be able to read all the way down to the 10th Amendment?

actually, the supreme court simply stated the constitution is silent on the issue, not that the federal government couldn’t pass a law.

It’s just that the federal government NEVER passed a law regarding abortion!

I think you are right on this. The Federal government could declare that abortion is murder, but I think most murder laws are state level and prosecuted by the states. Could they declare that abortion is not murder if before a certain time? I don't know. But there is no such federal law that I know of.

It's no surprise that overturn of Roe v. Wade is causing more election year RINO masks to fall off in federal and state governments.

These RINOs are clueless (blatantly ignoring?) that, in stark contrast to the rights that the early states famously protected in the Bill of Rights and other amendments, it remains that the states have never expressly amended the Constitution to give the corrupt, post-17th Amendment ratification feds the specific power to dictate, regulate, tax and spend for murder of unborn children purposes.

"From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added]." —United States v. Remove the connection between the doctor and the woman from the equation then getting an abortion is a commercial transaction, like any other purchase. The Commerce Clause may well give Congress the power to regulate that.

It really should be clear to these assclowns that this issue should be an issue for the STATES, not FedGov.
Read the Constitution, idiots. Look to the enumerated powers section. Look to the 10th Amendment.

I think the Commerce Clause is unconstitutional in most applications. This does not seem to directly apply to interstate commerce. They could possibly do it though.

Yes, that’s prima facie true.

Problem is, this was the exact issue that lead FDR to threaten the court with his now-infamous court packing plan in 1937.

It's track record in front of the Supreme Court is pretty good.

This does not seem to directly apply to interstate commerce.

If people are crossing borders to obtain abortions then it probably does.

Leave it to the states, as the Alito decision would do. It would be nice if this originalist court could also limit the scope of the Commerce Clause and the Due Process Clause, while also finding that the 10th Amendment still exists.

Congress will take attempts to restrict abortion with federal law as validating the Democrat attempts to codify Roe v Wade.
