One of the Supreme Court's longtime reporters said the "leading theory" is that a conservative clerk leaked the majority draft opinion indicating the high court is poised to overturn Roe v. Wade.
Nina Totenberg, a legal affairs correspondent for NPR, said the only theory that makes sense is that the leak came from someone who "was afraid that this majority might not hold."
"The leading theory is a conservative clerk who was afraid that one of the conservatives might be persuaded by Chief Justice Roberts to join a much more moderate opinion," Totenberg said during an appearance Sunday on ABC's This Week.
Totenberg also dismissed speculation that the leak originated from the liberal side.
"There's another theory that it was an outraged liberal clerk, but I think the only one that makes sense is that it came from somebody who was afraid this majority might not hold — that Chief Justice Roberts might persuade one of the conservatives to come over to him," Totenberg added.

I have no idea nor a good guess as to which side leaked it, but it doesn’t matter. If there were 5 votes to overturn it the leak will peel off a couple of them and the decision will go the other way.

According to my constitutional law professor at George Washington University in 1976, Nina carried on a relationship with Justice Potter Stewart (she was married to former Colorado senator Floyd Haskell); this is apparently how she became a leading Supreme Court correspondent.
On this story, Nina is full of BS. No law clerk with a full legal career ahead of him or her is going to give up that career and the high paying gig awaiting when the clerkship ends in early July. This is because when the leaker is outed, he or she will get disbarred.
I heard a theory (I think on the Sebastian Gorka radio show) that the leaker is a female law clerk to Justice Breyer, who was identified in the report as Elizabeth B. Deutsch. As Breyer is leaving the court at the end of this term, he really has nothing to lose by leaking the draft decision. He probably never has to have another face to face conference with the other eight sitting justices, The husband of the female law clerk is a reporter and apparently has collaborated with one of the Politico reporters in the past.
My guess is that investigators have a short list of suspects, and are simply looking for evidence that will stand up at trial, so as not to ruin a potentially innocent person’s life. I would want it no other way.
