The Department of Justice announced Tuesday evening the Biden administration will appeal Monday’s ruling by a federal judge in Florida that struck down mask mandates for air and Amtrak travel.
“The Department of Justice and the Centers for Disease Control and Prevention (CDC) disagree with the district court’s decision and will appeal, subject to CDC’s conclusion that the order remains necessary for public health. The Department continues to believe that the order requiring masking in the transportation corridor is a valid exercise of the authority Congress has given CDC to protect the public health. That is an important authority the Department will continue to work to preserve,” DOJ released in a statement. “On April 13, 2022, before the district court’s decision, CDC explained that the order would remain in effect while it assessed current public health conditions, and that the Transportation Security Administration would extend its directive implementing the order until May 3 to facilitate CDC’s assessment.”
“If CDC concludes that a mandatory order remains necessary for the public’s health after that assessment, the Department of Justice will appeal the district court’s decision,” the statement concludes.
Earlier today President Joe Biden was asked about the mandate and said the decision about whether to wear a mask while traveling is a personal choice. His new Wuhan coronavirus advisor pushed for the reinstatement of the mandate.
The left is addicted to being wrong
“This will help the Democrats in the midterms”
Are we being sarcastic here?

So they will be sunk by hanging on to a failed endeavor...
Midterms gonna bite em in the butt..
Also according to tonight’s X22, the CDC can’t provide any proof that masks work. That is the crux if the biscuit. There is no proof, so no mandate. They are probably just appealing to kill time.
Just let them try to mask airline passengers again after a taste of freedom. The ruckus-induced flight delays and cancellations would be epic.
“..The left is addicted to being wrong...”
The left is demonic...godless, vile.
Democrats making the midterms worse for themselves.
Optics. They want it both ways.
I also suspect that they are hoping that a new “superdoopermega dangerous” variant appears just in time for one of the stages of the inevitable appeals to be decided so they can use that as justification.
“This will help the Democrats in the midterms”
You’re either being facetious or an imbecile, which is it?
Why would the DOJ have a stake in this?
That's a reasonability issue - the CDC decision is not reasonable in that it is not supported by a faithful reading of the evidence.
That, however, is irrelevant because, according to the judge, Congress never gave the CDC the authority to impose a universal mask mandate.
Totalitarians just want to be totalitarians.
“Why does it involve them?”
Because the lawsuit was against the feds.
Yes thanks, and there is that too.
Gotta squash that freedom thing.
They have to keep the emergency orders and mask mandates in place this year so the Democrats have any chance to steal the election. Without the “need” for ballot harvesting, the socialists will get destroyed in the midterms. If the the Republicans can get enough Congress critters in place so Romney, Collins, and Murky (if she survives) can’t vote with the Dems, the Federal government grinds to a halt.
While I agree with the reasoning behind the ruling I think it’s appropriate that higher courts review the legality. Unlike hundreds of local/district courts that overstepped their authority to make decisions for the whole country as was done when President Trump was in office this one will be properly scrutinized.
It was on the morning fax that went out to all of the marxists.
For sure, if the republicans take over the majority, the asshat Marilick Garland needs to be impeached and if convicted (which he certainly will be since he is guiltier than sin itself) punished with the full force of the law.....
