Says 49 states' use of deadly force' laws. Texas is an exception, but only at night.

Texas Penal Code - PENAL § 9.42. Deadly Force to Protect Property

A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41 ;  and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime;  or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property;  and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means;  or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

Maybe in your state it isn’t. It is absolutely okay and legal in other states, like Texas.

If you are ever questioned by the cops, the only thing a person should say is LAWYER no matter how innocent you think you are.

They are not your friends, and they can and will lie to you to get you say what they want to hear.

Another thing to remember is after a police officer involved shooting, they are given at least 48 hours before they have to provide a statement and they always have their lawyer or a union representative appointed lawyer with them during all questioning.

Huh? Of course it is OK. Many states declare that it is. Noone has a right to steal your property. Heck even during the riots in LA people were onmthemrooftops,on the rooftops, stores from looters, and they had every right to,
do so. Store owners in many states are justified in shooting looters.

Good shoot. If I’m on the jury... Not guilty. In most States, deadly force by a private citizen is justifiable to stop the commission of a felony. Grand theft auto (AZ Class 3 felony) and theft of a registered machine gun are exactly that.

That needs to change. It is a travesty and the exact opposite of real justice.

I’m aware of the trend, mostly driven by the political Left... I just don’t agree with it in the strongest terms possible.

Yep, sounds like something I'd do. Guess what.. the little asshole doesn't steal anymore and all the little asshole thieves figure it out... is this car worth my life... check yes or no.

I'm slow clapping the use of deadly force in this case.

If you're a chump and don't mind getting your stuff stolen... well good for you. Just make it easy for thieves so they don't get hurt. Post your address and the stuff you don't mind getting stolen, in that manner, no one gets hurt.

Come to my house, steal from me and I'll obey the law.

Suppose a winning unsigned 100 million dollar lottery winning ticket was in the car? Or the perp is hijacking an armored truck full of unmarked bills? Or a very effective, difficult to procure, life saving medication that was being delivered to a gravely ill patient? And the perp had a gun and was waving it at you?

I no longer agree with that proposition.

I do not care what the "law" says.

In this case there was a fleeing felon in a car with stolen firearms. Reads like an "imminent danger to the community" to me. Had a police officer been the victim of this carjacking, it would have been ruled a justified shooting.

The State does not want subjects who can resist violent predators. That is because the State is the biggest predator out there.

That's a great post on the legality of lethal force. It actually reinforces my belief that if I ever was in a situation to use deadly force it would be to protect my family and myself.

I doubt I'd kill a man for stealing my truck but if my laptop was in it, I'd have a hard time letting someone loose with that much data, financial information and access on my accounts.... never to be recovered.

Bottom line is to say you "knew I was going to die" and then NOTHING ELSE... at all....., don't say "I then shot at him" or "I had to shoot him/her because I thought..." or ANYTHING....

JUST SAY, "I decline to make any other statements without a lawyer present". over and over and over. Say NOTHING at all ever to the police.... not one thing. Be polite, but just repeat that phrase and do not answer any questions or make any "statements" of what you think "the facts are".

Me too, not guilty. If it’s clear to me that’s there’s an aggressor and a victim, as seen here, then I don’t care what the law says... Want to stay alive? Don’t go into the carjacking business.

When I saw the headline, I thought that the firearms instructor was the carjacker. Maybe this headline would have been better: "Las Vegas firearms instructor charged with murder after shooting carjacking suspect".
