Sen. Marco Rubio (R-Fla.) on Sunday said “vice presidents can't simply decide not to certify an election,” breaking with former President Trump after he suggested that then-Vice President Mike Pence had the ability to overturn the results of the 2020 election.
Asked by moderator Margaret Brennan on CBS’s “Face the Nation” if he agreed with Pence — who on Friday said he had “no right to overturn the election” — Rubio said that after examining the matter, he concluded that vice presidents do not have the power to not certify an election.

Not a Rubio fan, but my read on the constitution does not give the VP the authority to reject electors once a state certifies it’s vote.
This process would have to take place at the state level before it ever reaches the VP.
I guess Rubio forgets what state he lives in.

If Trump gets re-instated it will be at the head of a rebel faction of the Army, and if any of them survive the counteroffensive, there probably will not need to be a VP.
Most of Congress will be dead or in prison, the Senate will not be in session, so no VP appointment will be needed.

Of course he is right. That is not what Pence should have done. There were electors challenged in their own state by another slate of electors. All the traitor had to do was send them back to their home state to get resolved. He knowingly accepted challenged electors.
It's becoming clear that most Republicans, if not all eventually, are planning on ostracizing Trump over this issue. Rather than focus on election integrity, they will attempt to make the case Trump's actions in response were the more egregious issue. Set your calendar for Mike Pence being the star witness of the prosecution, in one form or another.
Sadly, the only way Pence likely could have sent the dispute back to the states is if the GOP-led legislatures in those states, per their Constitutional power, sent their own certified slates of electoral votes to DC, creating dueling, certified slates of electors. However, the state GOPs created the alternate slates of electors, and I’m not sure that the parties themselves can officially certify diddly-daddly.
This fraud-riddled election occurred, and thanks to the weak-tea GOP, we will never know who really won, and we will have to live with the results.
Then that would tell me that these certifications are done under duress, which would make them all illegitimate.

In times past some states have had internal disagreements on what votes meant what. So much so that there were multiple “batches” of electors. Congress has to mediate this situation.
Pence wussed out. Blue swing states illegally “changed” (not amended) their voting laws in conflict with their state constitutions — which violates the US Const. Pence should have stood up for the US Const the day after the capital was cleared of all the Fed provocateurs and hauling off the murdered ex-Vet. He should have said that he could not accept such electors until the states sort it out.
Would that mean a delay? So bloody what? Worst case, ignore all electors from such states and go with what yah got.
If Trump is reinstated then the ticket is reinstated and Pence is the VP. But Trump is not going to be reinstated so it's all academic.
In the scenario you presented I don’t think the VP would even have the power to “send back” electoral votes for reconsideration. If a state legislature votes on a competing slate of electors, then the Constitution seems to state clearly that these electors must stand as the official slate of electors from that particular state.
The PA legislative session ended Nov. 30th 2020 and started back up on Jan. 5th. I believe Georgia were similar and the RINO governor Kemp, prevented a special session.
Regardless, the dopes are the legislators who did NOT sign on the memo to Pence.
