I think the Judge and Defense are playing it safe with their wording in front of the cameras so as not to cause any premature riots. That’s why I think the Judge does not give a direct answer and wants to see what the jury will decide before he takes any steps.

If he took your advice, you'd see an immediate interlocutory appeal from the prosecution that almost certainly would be upheld. Mistrial, with a different judge upon retrial.
