With prejudice is not a ruling that is made lightly. In high profile cases, such as this, there is almost no chance of that being the outcome.

And yet, the case against Cliven Bundy was dismissed with prejudice due to Brady violations and the dismissal was upheld even by the 9th Circus.

Better to ask for “with prejudice” as the judge can always do the lesser “without prejudice.”

There’s a certain lack of passion and indignation on the part of the defense lawyers in this case that’s puzzling.

They might think they got 10 or 11 jurors already on their side.

One of the lawyers said that the judge can issue a mistrial then 2 months later issue it "with prejudice"

I heard him say that.

I just think Kyle ‘on appeal’ winning... he might be physically abused or worse in prison. Any conviction could be a death penalty given the lying media narrative.

It is likely the jury didn’t seriously deliberate while they were waiting. Hopefully they review the videos, have another vote, and acquit him.

The judge needs to go to the jury room and tell them to $h1t or get off the pot. He should also remind him they’ll find nothing incriminating in the videos, and he’ll be ruling against the prosecution on them later.

If he took your advice, you'd see an immediate interlocutory appeal from the prosecution that almost certainly would be upheld. Mistrial, with a different judge upon retrial.
