LIVE: Kyle Rittenhouse Trial - Day 8 (with Day 1 being Jury Selection)

Today we have to wonder what will be the more likely cause of the next riot in Kenosha, Wisconsin. Will it be an acquittal of the defendant either by the jury or a directed verdict of Not Guilty? And if the latter happens will they riot because the judge is apparently a Lee Greenwood, even to the extent of have "God Bless the USA" as a ringtone on his phone.

The judge suggests that the trial should be ready to wrap up by Tuesday.

I expect soon that legislation will be introduced that no one may act in the capacity of a judge in a BLM/ANTIFA-related case unless they can prove that they share their vision of a defunct America. Never again will we see judges with pro-American values.

The thing is, as a matter of law, even if Kyle is reckless a minute or two earlier, that does not have any bearing on the heat of the moment.

Where prostitution is a crime, it isn't open season on prostitutes. They can break the law any number of times and still have a right to defend their lives, even if they put themselves in a dangerous situation. The law doesn't exclude them because they asked for trouble, or provoked the attacker.

They showed the two stills of the picture in question and it was so blurry I couldn’t see any detail at all - so I question its value. Perhaps the state wants to just plant a seed of doubt into the jurors minds, but overall it seems silly.

The whole issue of the individual frames grabbed from video to show that during a single frame, Kyle's rifle was for a tiny fraction of a second pointed in the general direction of Ziminski (who was armed) seems bizarre.

It would be dismissal with prejudice, wouldn't it be? I'm not sure myself but I think a dismissal is the correct term for when the prosecution brings a case that has no merit.

How many times have hunters accidentally “flagged” other hunters with their rifles? It’s sloppy gun handling, but no one reads into it that it’s a hostile intention.

Some have speculated that the prosecution has blown it so badly that they are trying for a mistrial so they would get another chance. A barrister can weigh in and tell us if dismissal would be the proper thing.

Yeah, that’s what I thought - a mistrial means the trial was irretrievably screwed up so they have to do it again. This would be Binger’s “do-over”. I don’t think you can declare a mistrial then close the door on another “with prejudice” but, yeah, a lawyer would be helpful to explain.

I only do civil cases but I believe the judge could end this right now by declaring a mistrial or entering judgment for the defense on the grounds the prosecution did not prove its case.

However, practicalities enter into the equation. If the judge is pretty sure the jury will acquit he may let it go to the jury for a defense verdict. It's much harder to appeal a jury verdict versus a judge's ruling on a motion. If he's wrong he can deal with it in post-trial motions.

The color stuff is crap. They are looking at the video on monitors. Different Monitors don’t even display colors the same. Ever walk by a display of television in the department store? Everyone showing the colors differently. This is all just to confuse the jury. It means nothing.

I'm prone to guess the following:

One or two of the jury will hold out for guilty just because they're lefty squirrels or scared of BLM&co and they'll come back reporting themselves Hung.

The Judge will then give 'em that "mistrial with prejudice".

The Judge, Rittenhouse and most of the jury will then all be candidates for Witness Protection Program (if there is any part of the government left that can be trusted) or just pack up and go someplace out of the line of fire and in a Constitutional Carry state.

I guess there’s all kinds of ways to skin a cat but it seems prudent to compare your finished product to the original to confirm there’s no surprises of unintentional alterations.

Him freely admitting this was another blow to a prosecution that’s been on their heels the entire time. These guys would probably ask OJ to try on the gloves again tomorrow.
