Witness: Kenosha shooting victim was acting ‘belligerently’

KENOSHA, Wis. (AP) — The first man shot and killed by Kyle Rittenhouse on the streets of Kenosha was acting “belligerently” that night but did not appear to pose a serious threat to anyone, a witness testified Friday at Rittenhouse’s murder trial.

Jason Lackowski, a former Marine who said he took an AR-15 semi-automatic rifle to Kenosha last year to help protect property during violent protests against racial injustice, said that Joseph Rosenbaum “asked very bluntly to shoot him” and took a few “false steppings ... to entice someone to do something.”

Lackowski got up from the witness stand and demonstrated what he called “false stepping.” He took a small step and slight lurch forward, then stopped.

But Lackowski, who was called as a witness by the prosecution, said he viewed Rosenbaum as a “babbling idiot” and turned his back and ignored him.

His testimony showed a contrast between how the military veteran viewed Rosenbaum and earlier testimony that Rittenhouse — who was 17 at the time — may have perceived Rosenbaum as a threat.

Richie McGinniss, who was recording events on a cellphone that night for the conservative website The Daily Caller, testified that Rosenbaum chased Rittenhouse and was gunned down as he lunged for the young man’s rifle.

“I think it was very clear to me that he was reaching specifically for the weapon,” McGinniss said.

The judge said they were not to be called victims but could be called rioters or looters. AP put the victim spin in there.

Was the shootee within 21 feet of the shooter and acting belligerently? That would be close enough to be dangerous, armed with a weapon or not.

I suspect the prosecution will rest earlier than planned for fear of making the case weaker.

Kyle will be acquitted as he should be.

Yeah? “Little men are less dangerous”? Was that it? Total BS. Some of the meanest scrappers I’ve ever seen were in the 5’4” range.

Binger's angle seems to be at this point:

Why did Kyle "take the weapon" to this "dangerous, 'largely peaceful' protest?" This thing was for the grown-ups. He had no business there. Also, he lacked the expertise with weapon to carry it, and this antagonized and triggered the rioters. Therefore he must go to the adult penitentiary! It's for society's sake.

(Wasn't he loaned the weapon in WI for his own self-protection?)

The thing that strikes me from my admittedly spotty review of the testimony is that we are in for a shock:

1.Kyles defense is incompetent as it is confident: they're playing their role straight ahead--apparently based on the assumption that they only need to rebut the prosecution's attempts to knock the foundation out from under the defense's self-defense claim.

2.THEY ARE LIKELY TO BE VERY WRONG!!

- Look again at that DA's performance-- casual, unflappable, imperturbable. He's playing to the audience.

- The DA is a curious study in a menacing type of personality found in government :

-- He's vain and fastidious, overly preoccupied with in appearance, almost the cliché' of the single gay male, but a general attribute of the 'red-line' narcissist.

--This preoccupation with external matters indicates that a deep chasm or a gaping wound lies at the heart.

--These people need to prove that they are "the smartest boy in the room." They must win. It doesn't help that Binger is sly and does have actual talent.
--They are ruthless in their ambition and bound for higher glory--in the hopes of filling in that void. Anyone is fair game, a stepping stone and nothing more in their quest.

--Upshot: Binger has a plan and is working an angle. He is a snake.

The defense is underestimating him!

What is Binger fishing for? Testimony for a subsequent indictment?

Watch out for something based on 'he had no business being there in the first place.'

Agree, little man syndrome. It’s real. This guy was just begging to hurt and destruct and wanted to show everyone how big and bad he was. It would be extremely hard for a legitimate juror to miss that.

.YOU ARE CORRECT!!!..........AND, I said this a month or so ago on FR. This is the ONLY way the judge can avoid an OJ type verdict in reverse.

More specifically, the Judge can’t risk the jury doing something stupid when the evidence is so overwhelmingly for KR and against the state.

We’re talking about a marine armed with an AR rifle and an unarmed 5 foot 3 guy?

I was in Army Signal Corp but remember some of my training. I would bet in the back of his mind the Marine was deciding whether to respond with a vertical butt stroke or a horizontal butt stroke if the idiot came after him.

Rifles make pretty good clubs.

Once the Prosecution rests I expect the defense to ask for a directed verdict of Not Guilty on all charges.

I believe the Judge will grant it.
