Southwest Airlines and American Airlines, both based in Texas, said Tuesday that they will continue plans to require employees to get vaccinated, despite an edict issued by Texas Gov. Greg Abbott that would ban vaccine mandates for private businesses in the state.
"Federal action supersedes any state mandate or law, and we would be expected to comply with the President's Order to remain compliant as a federal contractor," Southwest said in a statement to POLITICO, referencing the Biden administration's requirement that government contractors be vaccinated by Dec. 8.
"We will continue to follow all orders closely and keep our employees updated on any potential changes to existing policies," a spokesperson said, adding the airline is in the process of "reviewing all guidance issued on the vaccine."
Abbott on Monday signed a sweeping order effectively banning vaccine mandates for private businesses with 100 or more employees. Last month, the Biden administration said it will require that businesses with 100 employees or more must mandate vaccines or receive weekly Covid tests.
American Airlines said it's also reviewing Abbott's order and that so far airline officials "believe the federal vaccine mandate supersedes any conflicting state laws, and this does not change anything for American."
White House press secretary Jen Psaki called the federal mandates' legal mandate "unquestionable," and said Abbott is just playing politics.

Here is the catch—the airlines may have indirect contracts if they receive federal funds for flying federal employees.
This is a complex mess.
Yep, that’s a good idea. After all, if there are conflicting laws, then yes, the Fed law will supercede the state law. But if the Feds levy a tax/fine and the state levies a tax/fine, then there is no conflict at all. You have to pay both!

What if the employees don’t get vaccinated? Are they fired, or just grounded? Either way, I’m not sure Southwest or American are prepared for the consequences. Do they think Biden is going to write them another executive order to get them new pilots and crew? They will lose millions.

Both are for Fed employees or Contractors. Not hospital workers, airline workers, police officers, Costco, Walmart,....... There is no EO for employers with over 500 employees. No EO for OSHA to enforce. They just pretend there is.

Article VI, Paragraph 2 of the U.S. Constitution is commonly referred to as the Supremacy Clause. It establishes that the federal constitution, and federal law generally, take precedence over state laws, and even state constitutions.

A most excellent point, for private (non federal "contractor") companies. For companies in that position, which is most companies [1], there is no executive order, only Xiden's fever dream of a "mandate."
Southwest is a federal contractor.
