After the 2020 election, Arizona's Republican led Senate hired a cybersecurity firm with no election experience to audit over 2 million ballots from Maricopa County.[64] Arizona Secretary of State Katie Hobbs was concerned about security leaks during the audit. Brnovich responded and said the Department of Justice will not intervene without credible facts.[65]

In March 2021, Brnovich personally argued on behalf of Arizona in Brnovich v. Democratic National Committee, where he asked the Supreme Court to uphold Arizona election laws that restricted ballot collections and threw out votes that were cast in the wrong precinct.[66][circular reference] Brnovich argued that these laws were needed to "safeguard election integrity."[67] The Supreme Court ruled in a 6 to 3 decision in favor of the Arizona state voting laws.[68]
