Texas Supreme Court allows for arrest of Democrats who don’t show up to Legislature

The Texas Supreme Court has voided a state district judge’s temporary restraining order barring the arrest of Democratic lawmakers who have refused to return to the Legislature, putting in jeopardy the liberty of some Democrats who have returned to the state.

The all Republican high court’s order comes at the request of Gov. Greg Abbott and House Speaker Dade Phelan who petitioned the Texas Supreme Court on Monday to overturn a ruling by a Travis County state district judge that blocked them from ordering the arrest of Democratic lawmakers.

Now go send the Texas Rangers (not the baseball team) to go pick them up in DC.

They can only be arrested on these charges if and only if they are found within the boundaries of the state of Texas.

ANY citizen of Texas or a business could sue the Texas Democrat party for injury because they fled the state.

Without a quorum to legislate, basic law to protect citizens from nefarious elections can't be addressed.

What makes you think the rules apply anymore?

Not making a bet either way, but expecting the courts to go with TX is silly.

Until TX goes blue in a few years. Then it will be Cali with hotter weather.

Enough with the hyperbole.

Texas Constitution Article 3 Section 10:

Sec. 10. QUORUM; ADJOURNMENTS FROM DAY TO DAY; COMPELLING ATTENDANCE. Two-thirds of each House shall constitute a quorum to do business, but a smaller number may adjourn from day to day, and compel the attendance of absent members, in such manner and under such penalties as each House may provide.

This isn't a hard arrest, as in being booked into jail.

This is a soft legislative arrest, being apprehended and brought to the legislative chamber to force a quorum.

They don't even have to vote once they get there, they just have to be there.

Once the vote is taken, the "arrest" is over.

Note they took the time to state the political affiliation of the Texas Supreme Court, but didn’t say that the district Judge who ordered the injunction was a Democrat.

Fixed it.

I started in law enforcement in “98. Obviously went to court and grand juries. What most folks may not realize realize is how infrequently cops go to court, except for traffic court maybe. Because so many folks take a plea.

Anywho, it wasn’t until the administration before President Trump’s that I started paying attention to what really goes on.

For one, Roberts is a complete partisan moron

Two, it’s amazing and a shame how blatantly partisan the court system has become. You don’t, really, need to read anything more than a headline to know what political party a judge proscribes to or who appointed them. Insane.

The interesting thing is, if this were the other way around, knowing that it could end up in federal court, folks like Newsome or Cuomo would be sending folks to DC to make arrests. Even if just for the optics.

A show of force.

I hear that every all-you-can-eat salad bar is out of business in DC, and Miller Lite is sold out there.

OK Abbott: declare their offices vacant, turn off their cell phones we pay for, cancel their email accounts at the legislature, empty out their offices, fire their staff, cancel their paychecks and appoint interim successors pending the criminals return to TX justice, and hold snap elections. When they return, hold them without bail as flight risk until convicted.

If they let them get away with this, the minority in every legislature will see running away as a solution. They know this already, which is why they fled to DC.
