Ashli Babbitt, a California woman who participated in the U.S. Capitol riot on Jan.6, was "ambushed" by the Capitol Police officer who fatally shot her as she tried to enter the Speaker’s Lobby outside the House Chamber, a lawyer for the family said this week, according to reports.
The family plans to file a $10 million wrongful death lawsuit against the Capitol Police and the officer, the Washington Examiner reported.
Terry Roberts, a lawyer hired by Babbitt’s family who specializes in police misconduct cases, told Real Clear Investigations this week that he believes the officer didn’t give Babbitt verbal warnings before he fired.
"It’s not debatable. There was no warning," Roberts alleged. "I would call what he did an ambush. I don’t think he’s a good officer. I think he’s reckless."
The unidentified officer’s lawyer, Mark Schamel, has denied Roberts’ version of events.
"It’s a false narrative that he issued no verbal commands or warnings. He was screaming, 'Stay back! Stay back! Don’t come in here!'" he told Real Clear Investigations.
He said the officer’s warnings couldn’t be heard on cell phone video of the shooting because he was wearing a mask and the video was from the other side of the doors in a loud room.
"Lethal force is appropriate if the situation puts you or others in fear of imminent bodily harm," he continued. "There should be a training video on how he handled that situation. What he did was unbelievable heroism," according to the Examiner.

The shooter should be charged with murder because it was what it was period.
I think the only video that I’ve seen was taken by that Antifa guy, but I wouldn’t describe it as an “ambush”. On the other hand, I don’t see that the officer was in much danger when he shot her from about 6 feet away.
The Capitol police are all getting some award as I recall. Nobody is talking about who shot Ashli Babbitt. Doesn’t something seem very wrong here? I didn’t really do a lot when I was in the service many years ago, but by today’s standards, I guess i should be receiving The Congressional Medal of Honor.

Where do you get the notion that he accidentally discharged his weapon? His actions look very deliberate on the video.
Case is already closed. Nobody is going to be charged with anything.
Probably the shooter continues to get away with the shooting.

But they start with an indictment, and both the DOJ and the Capitol Police have said the shooter did nothing to be charged with. His shooting was justified.

indictments have to wait on a receptive audience and who is in power, if not handled by the book for both sides, look at Bidens Ukraine televised bribed corruption and a sitting president that did nothing in comparison impeached by the enemy in power.
It’s obvious that she was murdered by this kook and the (democrat) DOJ and the (democrat) Capitol Police gave him a pass. He is guilty of first degree murder and should be charged and tried for his crime. If the Jan 6 commission does not handle this issue, it loses all credibility. I, and a lot of other people will pay no attention to what they do if they do not handle this issue first. The way democrats operate is open for everyone to see.

Poor trigger discipline; his finger was ALWAYS on the trigger. Plus, he has lost his gun and an extra magazine before, he was careless.
I don’t think poor trigger discipline or a previous episode of carelessness proves that this shooting was “accidental”. I might weigh in determining if this was negligent homicide vs. premeditated murder, but it does not rule out intent at all. He drew the weapon, he purposefully pointed the weapon at Ashli Babbit and he pulled the trigger. Those are the objective facts we know. Placing his finger on the trigger might illustrate poor training, poor judgment or a purposeful act showing he intended to shoot all along.
