Judge Reinstates VA Teacher Suspended For Refusing To Affirm Trans Identity For Kids, Calls School Response ‘Vindictive’

A Loudoun County, Virginia, elementary school teacher who was placed on administrative leave in May for refusing to affirm transgender identity in children was reinstated by a judge Tuesday.

Byron “Tanner” Cross, who teaches physical education at Leesburg Elementary School, secured a temporary injunction from Judge James Plowman in his lawsuit against Loudoun County Public Schools (LCPS), according to an announcement from Alliance Defending Freedom (ADF), which defended him.

“BREAKING: Tanner Cross, a Virginia elementary school teacher and ADF client who was suspended for raising concerns to the board about a proposed gender policy, has won a temporary injunction and the judge has ordered his reinstatement,” ADF tweeted. “A massive victory for freedom of speech.”

Thankfully there are some sane judges left in this country. This evil act by the school was so beyond the pale, it had to be struck down. This madness has to be stopped, one lawsuit after another. That's the most direct recourse. The next step is to win school district leadership positions and take back the schools.

The best way to resolve this problem is to refuse to collect dues, pension payments etc. write it into the next contract, if the strike, hire teachers off the streets.

It's only a temporary injunction, but the judge made it clear that he issued the injunction based on "the weight of the evidence and the totality of the circumstances."

The defendants have 15 days to petition for a review of the ruling.

That school is going to pay out big $$$. I hope the teacher sues the teacher’s union because you know they were in on the firing.

Absolutely agree.

People need to get off their asses and start fighting. I hope the teacher prevails and the school board is replaced with people who have traditional values.

Expect the leftists to come out with a list of “scientists” and/or “medical professionals” and/or “educational professionals”, who will swear that gender is a fluid situation, which cannot be assigned by someone, based solely on physical attributes at birth.

I believe its the opposite. If not for the teacher’s union, no judge would have ever heard the case. The local school officials made the decision, then he went to his union rep for help which got him in front of a judge. If he were a non union worker employed by a private company, no chance at all his case would have been heard. IMHO

The union isn’t representing him - the Alliance Defending Freedom is. The union SHOULD be defending him. The fact that they are not is very telling.
