The Biden White House has released a preview of President Joe Biden's executive actions on gun control, which he plans to sign Thursday afternoon. The administration is also arguing additional gun control is needed to fight a "public health" crisis and pushing hard for "red flag laws," which often violate civil liberties.
"Today, the Biden-Harris Administration is announcing six initial actions to address the gun violence public health epidemic," the White House released late Wednesday. "This Administration will not wait for Congress to act to take its own steps."
Here are the six actions, from the White House "fact sheet."
The Justice Department, within 30 days, will issue a proposed rule to help stop the proliferation of “ghost guns.”
The Justice Department, within 60 days, will issue a proposed rule to make clear when a device marketed as a stabilizing brace effectively turns a pistol into a short-barreled rifle subject to the requirements of the National Firearms Act.
The Justice Department, within 60 days, will publish model “red flag” legislation for states.
The Administration is investing in evidence-based community violence interventions.
The Justice Department will issue an annual report on firearms trafficking.
The President will nominate David Chipman to serve as Director of the Bureau of Alcohol, Tobacco, and Firearms.
Biden's choice for ATF Director, David Chipman, is a longtime gun control activist who has done extensive lobbying for anti-Second Amendment groups funded by former New York City Mayor Michael Bloomberg and the Giffords Law Center. He was also involved in the Branch Davidian trial after the government -- specifically ATF and FBI -- botched a raid in Waco, Texas. Bad decisions made by federal agents ultimately resulted in the deaths of 76 people, including pregnant women and dozens of children.
All three are one decision away from being either an NFA item or a firearm. Right now there are a few court cases that say different, but if you get the wrong judge all of a sudden an AR pistol with an arm brace is a SBR and a bump stock a fully automatic machine gun.
80% lowers are a bit different, but they also are “asking” for trouble. Again, legal today but if you accidently drill a third hole by the selector switch a prosecutor can try to nail you for making a full auto.
It is the thing that pleads for legislative clarification, which in the climate of the last few years will not happen.

"For too long, conservative and traditionalist Americans have been outflanked, outspent, out-organized, and outmaneuvered by radical progressive legal organizations. It has been a years-long, one-sided legal assault. The consequences for American values, American society, and the American Constitution have been tragic and profound," Miller said in a statement unveiling America First Legal (AFL).
Miller told The Wall Street Journal that anything President Biden does "that we believe to be illegal is fair game."
Miller, 35, said the AFL was already working on a slew of lawsuits in Texas, hoping to use the same strategy that progressive groups used to block Trump administration policies by pursuing injunctions in more liberal court jurisdictions.

The biggest ones are the first two. They are going to try to make illegal for people to manufacture their own firearms for personal use without filing paperwork with Big Brother (so called ‘ghost’ guns). Not really enforceable for obvious reasons.
The second is the business about stabilizing braces getting around the 1934 NFA regulations on short barrel rifles. There will be ugly lawsuits over that because BATFE has approved these devices for use for a very long time. I kind of expect BATFE might make an announcement on the matter, and then never bother enforcing it.
The rest of it is bluster.
I am kind of surprised that they didn’t ban importation of cheap ammo from eastern Europe and Russia. Maybe Putin wrote Biden a check, that would be about his speed.
Overall it isn’t much. It kind of makes me think that they are aware they can’t quite torpedo the filibuster to pass something really heinous, or their internal polling is telling them that trying for an AWB might result in an electoral catastrophe for them. Typically, when administrations start slinging EOs around like this, it’s because they know Congress isn’t going to do anything.

Every bit of this needs challenged in court just on principal. I don’t expect to win, but there is a moral obligation to exhaust all reasonable means to redress grievances and assaults on civil rights.
The group, America First Legal Foundation, was unveiled Wednesday with the backing of Mr. Trump and a board of directors that includes former White House chief of staff Mark Meadows and former acting Attorney General Matt Whitaker, as well as others with deep ties to the conservative movement.
"Those who believe in America First must not shy away from using our legal system to defend our society and our families from any unlawful actions by the left," Miller said in a statement. "Those looking to hold the new administration in Washington to account finally have their answer. Our self-imposed policy of legal disarmament is now over."

Oh, and on an unrelated note, I have even heard that some people would go so far as to sprinkle expended 5.56mm brass (wiped clean of fingerprints, of course) all over the property of someone they wanted to be SWATted, so that regardless of whether they owned a firearm that could fire that cartridge, there would be extreme suspicion that they did, their house and property would get trashed and they would likely be hauled off to the local PD or ATF office. What a terrible thing to do to an innocent person, isn’t it?

Very thankful I live here. EVERY single red state needs to study up on nullification and just nullify every single garbage piece of legislation that these NAZI tyrants try to impose.
We really do have, under the second amendment, some fantastic cover for the situation we are in now. Unfortunately it does take knowledge and courage, both of whch are in short supply. The Fed gov does NOT have enough manpower to enforce these if states say no and refuse to cooperate. But we need to get it in gear and also start making coalitions of red states for nullification work.
