It would definitely be illegal for the government to do this.
It probably is not illegal for private parties to do this.
The question is whether the government is enough of a participant to lend it the government’s imprimatur.
It sounds like it, but I don’t know enough about it to give a definite opinion.

I don’t know if Oakland mayor contributed to the funds, but project is evidently privately funded.
"The program, funded by wealthy private donors, explicitly excludes poor white families"
So title of referenced article is misleading imo.
