California adults can smoke marijuana without fear of going to jail, but using it after hours can still have consequences at work.
A new bill in the Legislature aims to end a still common employment practice five years after Californians voted to legalize recreational cannabis in which private companies require can workers to test for marijuana use.
Assembly Bill 1256, introduced by Assemblyman Bill Quirk, D-Hayward, is intended to prevent employers from using past evidence of marijuana use, such as a hair or urine test, as justification for discrimination against an employee, such as denying or terminating employment, according to Dale Gieringer, director of California NORML, a sponsor of the bill.
"It is those tests that we want to ban, because they don't detect anything related to impairment," Gieringer said.
Hair and urine can be used to show that a person has consumed marijuana in the past, but not whether they are actively intoxicated with THC, the chief psychoactive ingredient in cannabis.

Why? Is it because drug use can affect job performance?
There are also insurance and liability issues.
Talk to contractors here, I live in Upstate NY, and you’ll find that it’s a nightmare trying to hire someone who’s not a pothead.
Companies don't just test for pot, there's other things like coke, heroin, meth, etc.......
I worked for a tier 1 auto stamping plant in Detroit and mandatory random drug testing for employees on probation was a part of the disciplinary control process.
The plant was a dangerous environment with all the presses and hi-lo's buzzing around. You don't want someone working in the shop who is high........
This is going to stimulate testing that actually shows impairment.
Either a breathe, blood or saliva test that correlates with a blood level of THC and indicates whether the person is actively impaired.
For example. imagine if that alcohol test you took while driving showed you had consumed alcohol in the last 2 weeks. Thats what current urine and hair testing for THC shows.
I don’t want someone who’s high installing my nat gas furnace, either.
Or doing my surgery.
Or driving on my highways.
Update on the WAR ON DRUGS - Drugs won
It’s more like Vietnam. No so much that we can’t win.. The will is lost.
I don’t want someone who is drunk doing those things either. But we legalize alcohol which is exponentially more harmful than pot
Can’t get a tree cutter job in my county without a weekly drug test. The insurance companies insist. With no testing virtually all legitimate tree companies would go out of business.
Good!
Who would you rather have pilot your jetliner? A pilot that smokes a joint or one that smokes a cigar?
Go peddle your drug agenda someplace else. You're not welcome here. Just because you're "tolerated", doesn't mean you're welcome.
Maybe newsom needs to rearrange funding to find some of the 85 bil he’s giving to the new wave of illegal immigrants. He still doesn’t have it. Last I checked ca was 55 B in debt.

Wow.
Besides, I am not the only Freeper here who has no issue with occasionally smoking and yes enjoying pot. It's legal now in most states so there in not much you can do about it.
Has there been a change in ownership that has not been announced? Or, is this a self-appointment to the morality police?
I support legalizing marijuana. The OP is correct, alcohol is many times more harmful to society than marijuana. Guess you'll be doing a lot more tolerating.
Submitting your bodily fluids to get and keep a job should be abolished. Treasure trove of people’s dna out there to be passed around.
Merci Beaucoup
