California cannot enforce indoor church ban amid pandemic: Supreme Court

The Supreme Court is telling California’s Santa Clara County that it can’t enforce a ban on indoor religious worship services put in place because of the coronavirus pandemic.

The high court issued an order Friday evening in a case brought by a handful of churches.

The justices, in early February, told the state of California that it can’t bar indoor church services because of the pandemic. The justices said at the time that the state could cap indoor services at 25% of a building’s capacity and continue to bar singing and chanting.

The justices’ unsigned order Friday said that their action was “clearly dictated” by their order from earlier this month. The court’s three liberal justices dissented.

Santa Clara had told the court in a letter Thursday that coronavirus cases in the county have recently continued to decline and that it was already close to lifting its ban on indoor gatherings. If the data continued the positive trend, the letter said, the county expected to allow all indoor gatherings, subject to restrictions, as soon as next Wednesday.

So the ban was illegal...people were illegally deprived of their 1st amendment right to worship as they choose...

What is the proper remedy for those damaged by the illegal order? What is the consequence for those who passed and enforced this illegal order?

There was a time when this sentence would have been true. There once was, many decades ago it seems, a group of people called liberals. They believed in the Bill of Rights, so much so they would take it too extremes. Well almost, they always had problems with the 2s. Today there are three communist justices on the SCOTUS. Hardly a victory for Orthodox Christians.

All of our services are 95% singing or chanting except for the Six Psalms, the sermon, and some of the Priest's quiet prayers.

Didn’t SCOTUS rule against a similar suit brought by some CA churches last spring - with Roberts voting with the four Dems? The majority must have refused to hear it - which is Roberts’ preferred method of voting with the liberals. But now he has voted the other way. He’s a joke.

Putting a limit on singing and chanting is so ridiculous. I’m surprised they didn’t say you couldn’t use the restrooms. Just goes to show how silly all of this is.

Yep.

Thomas is much better, but Alito (and Trump) were still keepers. The rest of the court, and all of Congress, are pretty well write offs so far as I can tell.

I’d suggested sometime back filling Congress and the rest of the court with 542 clones of Thomas. Unfortunately, he is a good Catholic and so I am sure would not consent.

And so it looks like the Republic is now dead, at least under this Constitution.

It was a good run. Three cheers for the for the Founding Fathers in general, and for Madison in particular. His system of checks and balances, if adhered to, was brilliant. Too bad Lincoln and the post Civil war and circa World War I amendments gutted the thing.

Sparta had, as one of my students explained to me recently, and even more effective system of checks and balances. There run in some ways was not as good, but it was much, much longer.

Maybe something else will emerge from this crisis. Where there is life there is hope, but so far as I can see, when Thomas goes, the last vestiges of the present Constitutional regime as anything other than a farce under which something else operates will go with him, unless Alito ratchets up his dissents, in which case he will have the privilege of shutting out the lights on the old order.

Trump may run in 2024. He may run a campaign that would win if the election was fair, but that is unlikely—but even if he does, will he have a better supporting cast the next time round? And he will be eight years older than his first kick at the can.

Currently in our Divine Liturgy, only a small choir is allowed to sing. The rest of us sit silently behind our masks. And we have capacity limitations. No proper veneration of icons, no hugging, kissing, or even shaking hands, no lunch after Liturgy. At least we can receive Holy Communion, with the Priest tossing the Communion down out throats!!!!

Getting vaccinated around here is very hard, with “limited supplies” of vaccine. I hope the J&J vaccine (which can be stored in a refrigerator) will accelerate things. Then I hope that transmission of the virus goes down to zero, and we can ditch our STUPID masks and get back to normal!!!!
